ՀՀ կառավարությանն առընթեր ազգային անվտանգության ծառայության կողմից իրականացված միջոցառումների արդյունքում 2017 թվականի մարտի 22-ին հայտնաբերվել է «Իգլա» տեսակի դյուրակիր զենիթահրթիռային համալիրի բաղկացուցիչ մաս կազմող, ռազմամթերք հանդիսացող «Իգլա» տեսակի դյուրակիր զենիթահրթիռային համալիրի արձակման խողովակ և նույն համալիրի «9М39» տեսակի հրթիռ:

Ինչպես տեղեկացրին ՀՀ գլխավոր դատախազությունից, ծանրացուցիչ հանգամանքներում ապօրինի կերպով ռազմամթերք ձեռք բերելու, պահելու, փոխադրելու և ռազմամթերքի մաքսանենգության դեպքերի առթիվ ՀՀ քրեական օրենսգրքի 235-րդ հոդվածի 2-րդ մասով և 235.1-րդ հոդվածի 2-րդ մասի 1-ին կետով 2017 թվականի մարտի 22-ին ՀՀ կառավարությանն առընթեր ազգային անվտանգության ծառայության քննչական վարչությունում հարուցվել է քրեական գործ:

Նշված հանցագործության կատարմանը մասնակցելու կասկածանքով 2017 թվականի մարտի 22-ին ձերբակալվել են երեք քաղաքացիներ, այդ թվում՝ Սամվել Անդրանիկի Բաբայանը: Նախաքննության ընթացքում ձեռք բերված բավարար ապացույցների համակցության հիման վրա մի խումբ անձանց կողմից նախնական համաձայնությամբ ապօրինի կերպով ռազմամթերք ձեռք բերելու, պահելու, փոխադրելու և ռազմամթերքի մաքսանենգության համար Սամվել Բաբայանին և նրա հանցակիցներին մեղադրանք է առաջադրվել ՀՀ քրեական օրենսգրքի 235-րդ հոդվածի 2-րդ մասով և 235.1-րդ հոդվածի 2-րդ մասի 1-ին կետով:

Թեև հանցագործության կատարման մեջ մեղադրվող անձինք առաջադրված մեղադրանքում իրենց մեղավոր չեն ճանաչել, սակայն կասկածյալի դատավարական կարգավիճակում հարցաքննության ընթացքում նրանք, այդ թվում՝ Սամվել Բաբայանը, ընդունել են իրենց առնչությունը նշված ռազմամթերքի ապօրինի շրջանառությանը և տեղեկություններ հայտնել դրա հանգամանքների վերաբերյալ: Երևան քաղաքի Կենտրոն և Նորք-Մարաշ վարչական շրջանների ընդհանուր իրավասության առաջին ատյանը, հիմնավոր համարելով մինչդատական վարույթն իրականացնող մարմնի միջնորդությունը, 2017 թվականի մարտի 24-ի որոշմա մբ մեղադրյալների նկատմամբ որպես խափանման միջոց է կիրառել կալանավորումը՝ 2 ամիս ժամկետով: Քրեական գործով նախաքննությունը շարունակվում է:
