Քրեական գործով մեղադրյալի պաշտպան Նարինե Մկրտչյանը ՀՀ հատուկ քննչական ծառայությունում հաղորդում է տվել այն մասին, որ իր պաշտպանյալ Դավիթ Պ.-ի վերաբերյալ քննվող քրեական գործի դատաքննության փուլում տեղեկացել է, որ ՀՀ քննչական կոմիտեի Երևան քաղաքի քննչական վարչության Մալաթիա-Սեբաստիա վարչական շրջանի քննչական բաժնում քննվող քրեական գործի նախաքննությունն իրականացնող քննիչը կազմել է «նախաքննության ավարտի վերաբերյալ մեղադրյալին և պաշտպանին հայտնելու մասին» արձանագրություն և ծանոթանալով արձանագրությանը` պարզել է, որ փաստաթղթի մեջ գրված իր ազգանունը և ստորագրությունը կեղծված է:

Ինչպես տեղեկացրին ՀՔԾ լրատվական ծառայությունից, դեպքի առթիվ ՀՀ հատուկ քննչական ծառայությունում ՀՀ քրեական օրենսգրքի 314-րդ հոդվածի 1-ին մասով հարուցվել է քրեական գործ: Հետագայում հիշյալ քրեական գործի նախաքննության ընթացքում տվյալներ են ձեռք բերվել, որ Դավիթ Պ.-ն դատարանում հայտնել է, որ իր կողմից գողության փորձ կատարելու վերաբերյալ հարուցված քրեական գործի նախաքննությունն իրականացրած քննիչն իր նկատմամբ ստորագրություն չհեռանալու մասին խափանման միջոց կիրառելու և համաներման ակտի հիմքով գործի վարույթը կարճելու համար իրենից պահանջել է 1.500 ԱՄՆ դոլար, սակայն ինքը չի տվել նշված գումարը, այդ իսկ պատճառով իր նկատմամբ իրականացվել է քրեական հետապնդում:
