Ոստիկանության նպատակը ոչ թե հանրահավաք անցկացնելու սահմանադրական իրավունքից օգտվելն ապահովելն էր, այլ ուղղակի՝ պատժելը: Բազմաթիվ էլեմենտներ սա են վկայում: «Sputnik-Արմենիա» ռադիոկայանի հետ զրույցում նման համոզմունքն է հայտնել Միջազգային իրավունքի մասնագետ Արա Ղազարյանը՝ անդրադառնալով վաղ առավոտյան Բաղրամյան պողոտայում տեղի ունեցած բախումներին:

«Այնտեղ քաղաքացիական հագուստներով բազմաթիվ քողարկված ոստիկաններ կային: Նման քողարկված միջոց սովորաբար կիրառում են կազմակերպված հանցագործության դեմ պայքարի շրջանակում: Մինչդեռ այս պարագայում, ունենք մարդիկ, ովքեր խաղաղ նպատակով հանրահավաք են անում: Ճիշտ է, չեմ ասում, թե այնտեղ ատելության խոսք, կոչեր չէին հնչում, փակել էին քաղաքի կենտրոնական փողոցը, այնուհանդերձ, ամեն դեպքում, դրանք այն գործողությունները չեն, որպեսզի ցուցարարների նկատմամբ կիրառվեր քողարկված գործողություններ: Այսինքն, ընդհանուր առմամբ, կիրառված ուժը եղել է ոչ անհրաժեշտ»,-ընդգծել է նա:

Փորձագետն ընդունում է, որ օրենքով ոստիկանությունն իրավունք ունի ուժ կիրառելու, ինչը ոչ-ոք չի վիճարկում:

Նա նաեւ ընդունում է, որ այս պրակտիկան կիրառվում է ամբողջ աշխարհում: «Ես ավելի շատ եվրոպական, այլ ոչ թե ամերիկյան չափանիշներին կհամեմատեի, որովհետև մենք ավելի շատ եվրոպական ընտանիքի անդամ ենք:

Իրավունքն ասում է՝ ոստիկանությունը ոչ թե պետք է գնահատի ցուցարարների պահանջի օրինականությունը, այլ պետք է հնարավորինս ապահովվի, որ ցուցարարներն օգտվեն հանրահավաք անցկացնելու իրենց իրավունքից: Ճիշտ է, ոստիկանությունն անընդհատ փորձում էր համաչափության սկզբունքն ապահովել` նախօրոք զգուշացումներ էր անում, ամբողջ գիշեր բանակցություններ էր վարում և այլն: Բայց որոշ գործողություններ մատնում են, որ նրանց իրական նպատակը եղել է ցուցարարներին պատժելը: Հիմա կտեսնենք շարունակությունը, եթե քրեական գործեր հարուցվեն, ապա դա իսկապես խիստ անհամաչափ միջամտություն կլինի ցուցարարների իրավունքներին»,-ասել է Ղազարյանը:

Միջազգային իրավունքի մասնագետը եւս մեկ անգամ շեշտադրել է, որ ոստիկանության առաջնային նպատակը պետք է հանարահավաքի բնականոն ընթացքն ապահովելը, մեկ բացառությամբ՝ եթե հնչում են բռնության կոչեր, և կան օպերատիվ տվյալներ , որ բռնություն է կիրառվելու: «Մնացած ոչ մի դեպքում ոստիկանությունն իրավունք չունի միջամտելու, առավել ևս՝ գաղտնի միջոցներ կիրառելու»,-եզրափակել է Արա Ղազարյանը:
