ՀՀ օմբուդսմենը հիշեցրել է խոշտանգումների դեպքերի արդյունավետ կանխարգելման միջոցները

ՀՀ մարդու իրավունքների պաշտպան Կարեն Անդրեասյանը խոշտանգումների զոհերի աջակցության միջազգային օրվա առնչությամբ հիշեցրել է, որ խոշտանգումների դեպքերի արդյունավետ կանխարգելումը և դրանց առավելագույն բացառումն ուղղակիորեն փոխկապակցված է խոշտանգումների մասին հաղորդումների արագ, օբյեկտիվ ու մանրակրկիտ քննության իրականացման և քրեական պատասխանատվության անխուսափելիության հետ: Ինչպես  տեղեկացրին Մարդու իրավունքների պաշտպանի աշխատակազմից, օմբուդսմենը ցավով է արձանագրել, ոչ այս ուղղությամբ իրավասու մարմինների կողմից ձեռնարկվող միջոցները շատ դեպքերում բավարար չեն, իսկ երբեմն կրում են զուտ ձևական բնույթ:

«Խոշտանգումների վերաբերյալ հաղորդումներին իրավապահ մարմինները երբեմն համարժեք չեն արձագանքում՝ ընդհանրապես հրաժարվելով քննություն իրականացնելուց: Իսկ այն դեպքերում, երբ քննություն է իրականացվում, հաճախ այն լինում է մակերեսային և կողմնակալ»,- նշվում է Կարեն Անդրեասյանի հայտարարության մեջ: Նա հիշեցրել է օմբուդսմենի տարեկան վերջին զեկույցում հատուկ նշված ազատությունից զրկված անձանց վնասվածքների դեպքերի քննության լուրջ թերությունների մասին: Մասնավորապես, ձերբակալված և կալանավորված անձանց պահման վայրեր, ինչպես նաև քրեակատա րողական հիմնարկներ ընդունված մի շարք անձանց մոտ հայտնաբերվել են մարմնական վնասվածքներ, սակայն հետագայում դրանց կապակցությամբ քրեական գործի հարուցումը մերժվել է կամ քրեական գործը՝ կարճվել: Անդրեասյանը նշել է, որ, որպես կանոն, գործերի չհարուցման կամ դրանց կարճման հիմքում դրվել են հենց ձերբակալված և կալանավորված անձանց պնդումները, որ իրենք վնասվածքները ստացել են սայթաքելու կամ ընկնելու հետևանքով: Սակայն այդ պնդումների հավաստիության մեջ համոզվելու ուղղությամբ անհրաժեշտ այլ գործողություններ չեն իրականացվել:

«Միայն պաշտոնատար անձանց անպատժելիության զգացումը բացառելու և պատասխանատվության անխուսափելիությունն ապահովելու դեպքում հնարավոր կլինի շոշափելի արդյունքի հասնել խոշտանգումների դեմ պայքարի գործում»,- նշել է ՀՀ օմբուդսմենը:
