Քննիչի նկատմամբ բռնություն գործադրելու առթիվ քրեական գործը ուղարկվել է դատախազին

ՀՀ քննչական կոմիտեի Երևանի քննչական վարչությունում ավարտվել է քրեակատարողական հիմնարկում ՀՀ հատուկ քննչական ծառայության քննիչի նկատմամբ բռնություն գործադրելու դեպքի առթիվ հարուցված քրեական գործի նախաքննությունը: Ինչպես տեղեկացրին ՀՀ քննչական կոմիտեի դեպարտամենտի տեղեկատվության և հասարակայնութան հետ կապերի բաժնից, քննությամբ պարզվել է, որ 2015 թվականի հունիսի 2-ին, ժամը 15:00-ի սահմաններում, ՀՀ արդարադատության նախարարության «Նուբարաշեն» քրեակատարողական հիմնարկի քննչական գործողությունների կատարման համար նախատեսված թիվ 3 սենյակում ՀՀ հատուկ քննչական ծառայության քննիչն իրականացրել է առերես հարցաքննություն՝ նույն քրեակատարողական հիմնարկի կալանավորի և Աշտարակի բաժնի համայնքային ոստիկանության բաժանմունքի պետի միջև։ Քննչական գործողության ժամանակ կալանավորն սկսել է հայհոյել ոստիկանության նախկին պաշտոնյաներից մեկին, ապա ն աև` ընդհանրապես ուսադիրներ կրող աշխատակիցներին։ 

Նախնական քննության ընթացքում բավարար ապացույցներ են ձեռք բերվել, որ կալանավորը չի ենթարկվել հայհոյանքները դադարեցնելուն ուղղված քննիչի պահանջներին, բռունցքով հարվածել է վերջինիս դեմքի աջ հատվածին` դրանով իսկ գործադրելով կյանքի կամ առողջության համար ոչ վտանգավոր բռնություն` կապված իշխանության ներկայացուցիչ հանդիսացող քննիչի կողմից իր ծառայողական պարտականությունները կատարելու հետ:

Մինչդատական վարույթի ընթացքում ձեռք բերված ապացույցների համակցությամբ՝ ՀՀ ԱՆ «Նուբարաշեն» քրեակատարողական հիմնարկի կալանավորին մեղադրանք է առաջադրվել ՀՀ քրեական օրենսգրքի 316-րդ հոդվածի 1-ին մասի հատկանիշներով:

Քրեական գործը՝ մեղադրական եզրակացությամբ, ուղարկվել է նախաքննության օրինականության նկատմամբ հսկողություն իրականացնող դատախազին:
