Վրաստանը Ռուսաստանից 70 մլն եվրո է պահանջում 2006 թվականի արտաքսման համար

Վրաստանի արդարադատության նախարարությունը հուլիսի 2-ին, նպատակ ունենալով վերականգնել Ռուսաստանից 2006 թվականին զանգվածային կերպով արտաքսված Վրաստանի քաղաքացիների իրավունքները, Մարդու իրավունքների եվրոպական դատարան է ներկայացրել իր դիրքորոշումը ներառող փաստաթուղթ և Մոսկվայից 70,3 միլիոն եվրոյի փոխհատուցում պահանջել, հաղորդում է Interfax.ru-ն:

Ինչպես ասված է ուրբաթ օրը Վրաստանի արդարադատության նախարարության տարածած հայտարարության մեջ, փաստաթուղթը հիմնվում է «Վրաստանն ընդդեմ Ռուսաստանի» հայցով Մարդու իրավունքների եվրոպական դատարանի 2014 թվականի հուլիսի 3-ի որոշման վրա, որը վերաբերում է 2006 թվականին ՌԴ-ից Վրաստանի քաղաքացիների զանգվածային արտաքսմանը։

Դատարանը ճանաչել է, որ 2006 թվականին Ռուսաստանը խախտել է Մարդու իրավունքների եվրոպական կոնվենցիայի մի քանի հոդված, այդ ժամանակ վրացիների դեմ համակարգված քաղաքականություն է իրականացվել: Մարդու իրավունքների եվրոպական դատարանը որոշել է, որ Ռուսաստանը պետք է փոխհատուցում վճարի Վրաստանին՝ երկրի քաղաքացիների իրավունքները խախտելու համար:

Փոխհատուցման չափը որոշելու համար կողմերին տրվել է 12-ամսյա ժամկետ: Հարցը պետք է լուծեին երկու երկրների արդարադատության նախարարությունները; Ընդ որում՝ եթե կողմերը չգան համաձայնության, Ստրասբուրգի դատարանն իրավունք ունի ինքնուրույն լուծել այդ հարցը:

Ինչպես ասված է Վրաստանի արդարադատության նախարարության հայտարարության մեջ, ՌԴ արդարադատության նախարարությունից ոչ մի փաստաթուղթ կամ դիրքորոշում չի ստացվել: Դա հաշվի առնելով՝ Մարդու իրավունքների եվրոպական դատարանի կանոններով և ՌԴ արդարադատության նախարարության հետ բանակցությունների անհնարինությունից ելնելով՝ Վրաստանի արդարադատության նախարարությունն իր դիրքորոշումը ներառող փաստաթուղթ է ներկայացրել փոխհատուցման վերաբերյալ:
