Ցմահ դատապարտյալը, հացադուլից դուրս գալով, դիմել է դատարան

Երեկ «Նուբարաշեն» ՔԿՀ-ի դահլիճում Էրեբունի և Նուբարաշեն վարչական շրջանների ընդհանուր իրավասության դատարանը դատավոր Արտուշ Գաբրիելյանի նախագահությամբ արտագնա նիստ էր հրավիրել: Նիստը տեւեց մոտ չորս րոպե, քանի որ Էրեբունու դատախազության ներկայացուցիչ, դատախազ Հայկ Մովսիսյանը հայտարարեց, որ ցմահ դատապարտյալի անձնական գործին ծանոթանալու համար իրեն ժամանակ է պետք:

Հիշեցնենք, որ ցմահ դատապարտյալ Ստեփան Գրիգորյանը 20 տարի պատիժ է կրում «Նուբարաշեն» ՔԿՀ-ում: Դատարանում վիճարկվում է բանտի վարչական հանձնաժողովի որոշումը` Ս. Գիրգորյանի պայմանական վաղաժամկետ ազատման հարցը մեկ տարով հետաձգելու մասին: Թեպետ ընթացող նիստի ժամանակ դատապարտյալը ցանկանում էր ներկայացնել իր դիրքորոշումը, սակայն դատավորը նշեց, որ նիստը հետաձգվում է մինչև հուլիսի 7-ը: Նախագահողը հայտնեց, որ Ս. Գրիգորյանը կարող է իր դիրքորոշումը հայտնել հաջորդ դատական նիստին: Իսկ մինչ այդ Արտուշ Գաբրիելյանը ճշտեց դատապարտյալի տվյալները: Գրիգորյանը նշեց, որ ծնվել է 1963թ., Երևանում, ունի 10-ամյա կրթություն: Նա ձերբակալվել է դեռևս 1996թ.: 1997թ. դեկտեմբերի 25-ին Գերագույն դատարանի որոշմամբ դատապարտվել է մահապատժի՝ 1961թ. քրեական օրենսգրքի 99 հոդվածի 1-ին և 7-րդ կետերով մեղադրվել է սպանության գործով` որպես մասնակից. «2003թ. նախագահի ներման հրամանագրով մի պատիժը փոխվել է մյուսով»,-ասաց ցմահ դատապարտյալը` հրաժարվելով հանրային պաշտպան ունենալուց:

Տեղեկացնենք եւ հիշեցնենք, որ մայիսի 14-ին լրացել էր ցմահ դատապարտյալի պատժի կրման 20 տարին: Ըստ քրեական օրենսգրքի հոդված 76-ի կետ 5-ի՝ ցմահ ազատազրկման դատապարտված անձը կարող է պայմանական վաղաժամկետ ազատվել, եթե դատարանը գտնի, որ նա պատիժը հետագա կրելու կարիքը չունի և փաստորեն կրել է ազատազրկման ոչ պակաս, քան քսան տարին:

Տեղեկացնենք նաև, որ ըստ ցմահ դատապարտվածի տրամադրած տեղեկության` մայիսի 29-ին «Նուբարաշեն» ՔԿՀ-ի վարչական հանձնաժողովը քննարկել էր հարցը, իսկ հունիսի 2-ին դատապարտյալը ստացել էր պատասխան. ներկայացված տեղեկանքում գրված է եղել հարցը հետաձգել մեկ տարի ժամկետով: Որպես բողոք՝ Ս. Գրիգորյանը հունիսի 3-ին հացադուլ էր հայտարարել, ապա դիմել Էրեբունի և Նուբարաշեն վարչական շրջանների ընդհանուր իրավասության դատարան` վարչական հանձնաժողովի հետաձգման որոշումը վիճարկելու համար:
