Գողության մեջ մեղադրվող ՀՀ քաղաքացին հայտնել է այն մասին, որ ոստիկանության պաշտոնյաները չարաշահել են իրենց լիազորությունները: Ինչպես  Արմենպրեսին տեղեկացրին ՀՀ հատուկ քննչական ծառայությունից, մի խումբ անձանց կողմից նախնական համաձայնությամբ խոշոր չափերով գողություն կատարելու մեջ մեղ ադրվող Աննա Մ.-ն իր նկատմամբ կալանավորումը որպես խափանման միջոց ընտրելու մասին դատական նիստի ժամանակ հայտնել է, որ ՀՀ ոստիկանության պաշտոնատար անձինք ամբողջ ընթացքում իմացել են իր և ամուսնու գտնվելու վայրի մասին, ինքը պարբերաբար հեռախոսակապի մեջ է եղել ՀՀ ոստիկանության Գորիսի բաժնի օպերատիվ գծով տեղակալի և նույն բաժնի օպերլիազորի հետ: Սակայն վերջիններս, չարաշահելով իրենց պաշտոնեական լիազորությունները, չեն կատարել քննիչի հանձնարարականը, չեն ձեռնարկել միջոցներ իրենց հայտնաբերելու և նախաքննական մարմնին ներկայացնելու ուղղությամբ: Այս կերպ` ոստիկանության աշխատակիցներն իրենց հայտնաբերելու պատրանք ստեղծելով արհեստականորեն բարձրացրել են բաժնի ցուցանիշները, և իրենց նախաքննական մարմին ներկայացրել են միայն այն ժամանակ, երբ քննիչի որոշմամբ իրենց նկատմամբ հայտարարվել է հետախուզում, իսկ իր նկատմամբ որպես խափանման միջոց կալանավորումը ընտրելու մասին քննիչը միջնորդություն է ներկայացրել դատարանին:

Դատարանը, նկատի ունենալով հիշյալ հանգամանքը, չի բավարարել քննիչի միջնորդությունը` Աննա Մ.-ի նկատմամբ որպես խափանման միջոց կիրառել կալանավորումը: Վերջինիս նկատմամբ որպես խափանման միջոց ընտրվել է ստարագրություն չհեռանալու մասին:

Աննա Մ.-ի հաղորդման հիման վրա` պաշտոնատար անձանց կողմից պաշտոնեական լիազորությունները չարաշահելու դեպքի առթիվ ՀՀ քննչական կոմիտեում ՀՀ քրեական օրենսգրքի 308-րդ հոդվածի 1-ին մասի հատկանիշներով հարուցված քրեական գործը քննության է ուղարկվել ՀՀ հատուկ քննչական ծառայություն: 

Կատարվում է նախաքննություն:

Ծանուցում. Ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորություննապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտածդատավճռով:
