Պետք է օրենքով կարգավորել պատմամշակութային արժեքների կողքին խաղատներ ու զվարճանքի վայրեր չկառուցելու հարցը. իրավաբան

Կառավարության՝ Կ.Դեմիրճյանի անվան Մարզահամերգային համալիրը վաճառքի միջոցով օտարելու որոշումը քաղացիների շրջանում լայն քննարկումների առիթ է դարձել: Շատերին դուր չի եկել այն գաղափարը, որ նման պատմամշակութային արժեք ունեցող շենքի տարածքում լինելու է զվարճանքի կենտրոն, հյուրանոց, խաղատուն…

Ինչ վերաբերում է խաղատանը, կարծիքներ են հնչում, որ Համալիրի հարակից տարածքում խաղատուն կառուցելը օրենքի խախտում է, քանի որ, ըստ Խաղատների մասին օրենքի, չի թույլատրվում քաղաքի կենտրոնում խաղատներ կառուցել:

Orer.am-ը զրուցեց իրավաբան Տիգրան Սարգսյանի հետ՝ պարզելու համար՝ արդյո՞ք տեղին է քաղաքացիների անհանգստությունը այն մասին, որ Մարզահամերգային համալիրի հարակից տարածքում խաղատուն կառուցելը անօրինական է:

«Քաղաքում խաղատուն կարելի է կառուցել, եթե կա խոշոր ներդրումային ծրագիր: Ըստ Խաղատների մասին օրենքի 6-րդ հոդվածի 3-րդ պարբերության Գ ենթակետի՝ Կառավարության որոշմամբ կարող է թույլատրվել խաղատուն կառուցել, եթե ներդրումը 30 մլրդ դրամից ավելի է: Իսկ այս դեպքում ունենք 100 մլրդ դրամի ներդրման ծրագիր:

Այստեղ հարցն ավելի շատ բարոյական է, քան օրինական, օրենքը ամեն ինչ չի կարող նախատեսել: Ոչ ոք չէր կարող մտածել, որ որևէ մեկը կգա ու կցանկանա պատմամշակությանին արժեքի կողքին խաղատուն կառուցել: Հարցը թողնված է Կառավարության բարեխղճության վրա, բայց, եթե տեսնում ենք, որ այդպիսի երևույթ է տեղի ունենում, հույսներս չպետք է դնենք Կառավարության վրա, պետք է այդ հարցը նույնպես կարգավորել օրենքով, որպեսզի ազգային, պատմամշակութային արժեքների կողքին խաղատներ, զվարճանքի վայրեր չկառուցվեն»,- մեզ հետ զրույցում ասաց իրավաբանը:

Հիշեցնենք, որ օրեր առաջ ՀՀ կառավարության նիստում որոշում կայացվեց «Կարեն Դեմիրճյանի անվան մարզահամերգային համալիր» պետական ոչ առևտրային կազմակերպությունը օտարել ՆՏԱԱ ԻՆՎԵՍՏՄԵՆՏ ԳՐՈՒՊ սահմանափակ պատասխանատվությամբ ընկերությանը: Ընկերությունը պատրաստվում է Համալիրի հարակից տարածքում ժամանցի կենտրոն կառուցել, որն ընդգրկելու է հյուրանոց, փակ ջրաշխարհ, համերգային դահլիճներ, հանդիպումների սրահներ, ռեստորաններ, խանութներ ու խաղատուն:

Նշենք նաև, որ Համալիրը գնած ընկերությունը ընդամենը մեկ ամիս առաջ է գրանցվել:
