Պարտապանի մահվան դեպքում պարտատերերն իրավունք ունեն ժառանգության բացման օրվանից վեց ամսվա ընթացքում իրենց պահանջները ներկայացնել ժառանգությունն ընդունած ժառանգին կամ կտակակատարին, իսկ նշված անձանց բացակայության դեպքում` ժառանգության բացման վայրի նոտարին, մինչև ժառանգների կողմից ժառանգության իրավունքի վկայագիր ստանալը: Այս մասին Արմենպրես-ին տեղեկացրին ՀՀ արդարադատության նախարարության տեղեկատվության և հասարակայնության հետ կապերի բաժնից:

Ինչ վերաբերում է ժառանգության ընդունման կարգին ու ժամկետներին՝ ապա ժառանգությունը կատարվում է ըստ օրենքի և ըստ կտակի: Այն կատարվում է ըստ օրենքի, եթե չկա կտակ, կամ դրանում սահմանված չէ ամբողջ ժառանգության ճակատագիրը, ինչպես նաև ՀՀ քաղաքացիական օրենսգրքով սահմանված այլ դեպքերում:

Ժառանգությունը ձեռք բերելու համար ժառանգը պետք է այն ընդունի, իսկ ժառանգությունն ընդունվում է ժառանգությունն ընդունելու կամ ժառանգական իրավունքի վկայագիր ստանալու մասին ժառանգի դիմումը ժառանգության բացման վայրի նոտարին հանձնելով: Ժառանգությունը կարող է ընդունվել ժառանգության բացման օրվանից վեց ամսվա ընթացքում: Դրա բացման ժամանակը քաղաքացու մահվան օրն է, իսկ նրան մահացած ճանաչելու դեպքում՝ այդ մասին դատարանի վճիռն օրինական ուժի մեջ մտնելու օրը, եթե այլ օր սահմանված չէ վճռում: Ժառանգության բացման վայրը ժառանգատուի բնակության վերջին վայրն է: Ի դեպ, Երևանում մինչև մահը բնակված անձանց ժառանգները կարող են գրավոր դիմել և ժառանգության իրավունքի վկայագրեր ստանալ ժառանգության բացման վայրի՝ Երևան քաղաքի ցանկացած նոտարական տարածքի նոտարների կողմից։
