Սահմանադրական բարեփոխումների նախագծում կլինեն փոփոխություններ

Ազգային ժողովի քննարկմանը ներկայացված սահմանադրական բարեփոխումների նախագիծը վերջնական չէ և ենթակա է փոփոխությունների: Այս մասին Ազգային ժողովում սահմանադրական բարեփոխումերի նախագծի քննարկման ժամանակ նշեց ՀՀ Նախագահի ներկայացուցիչ, Սահմանադրական բարեփոխումների մասնագիտական հանձնաժողովի նախագահ Վարդան Պողոսյանը՝ պատասխանելով ԲՀԿ խմբակցության ղեկավար Նաիրա Զոհրաբյանի հարցին՝ նախագծում կայուն մեծամասնության ապահովման և ընտրությունների երկրորդ փուլի անցկացման վերաբերյալ դրույթների հնարավոր փոփոխությունների մասին:

«Սահմանադրական բարեփոխումների մասնագիտական հանձնաժողովի և Վենետիկի հանձնաժողովի համատեղ քննարկումների արդյունքում համաձայնության ենք եկել նախագծում մի շարք փոփոխությունների իրականացման հարցում, որոնք Ազգային ժողովի քննարկմանը ներկայացված նախագծում դեռևս կատարված չեն: Ես դրանց կանդրադառնամ Ազգային  ժողովում իմ եզրափակիչ ելույթում և կներկայացնեմ այն փոփոխությունները, որոնք ընդունելի են ՀՀ Նախագահի համար և ուղարկվել են նաև Վենետիկի հանձնաժողովի քննարկմանը»,- ընդգծեց Պողոսյանը:

Անդրադառնալով նախագծի 89-րդ հոդվածին, որում խոսվում է կայուն մեծամասնության ապահովման  և, անհրաժեշտության դեպքում, խորհրդարանական ընտրությունների երկրորդ փուլ անցկացնելուն՝ Վարդան Պողոսյանը պարզաբանեց, որ սահմանադրական փոփոխությունների վերաբերյալ Վենետիկի հանձնաժողովի միջանկյալ զեկույցում այդ հոդվածի առաջին և երկրորդ մասերը մնացել են նույնը, որոշ փոփոխությունների է ենթարկվել երրորդ մասը: 

«Իսկ երրորդ մասն ունի հետևյալ տեսքը՝  ԱԺ-ն ձևավորվում է համամասնական եղանակով, ընտրական օրենսգիրքը երաշխավորում է կայուն մեծամասնության առակայությունը, իսկ եթե կայուն մեծամասնություն չի ապահովվել, կարող է անցկացվել ընտրությունների երկրորդ փուլ: Այստեղ հատուկ ընդգծում եմ «կարող է» բառը, որովհետև նախագծի նախնական տարբերակում այս դրույթը ներկայացված էր իմպերատիվ տարբերակով: Քաղաքական կոալիցիայի ձևավորման սահմանափակումները, պայմանները և կարգը սահմանվում են ընտրական օրենսգրքով»,- եզրափակեց Վարդան Պողոսյանը:
