Եվրոպական դատարանն ամբողջությամբ բավարարեց Փերինչեքի գործով ՀՀ կառավարության պահանջները

Եվրոպական դատարանը 2015 թվականի հոկտեմբերի 15-ին հրապարակեց Փերինչեքն ընդդեմ Շվեյցարիայի գործով վճիռը: Այդ գործում Հայաստանի Հանրապետությունը ներգրավված էր որպես երրորդ կողմ: Գործին մասնակցելով երրորդ կողմի կարգավիճակում՝ Հայաստանի Հանրապետությունն ակնկալում էր, որպեսզի Եվրոպական դատարանի վճռից բացառվեն ձևակերպումներ, որոնք կարող են որևէ կերպ կասկածի տակ առնել Հայոց ցեղասպանության փաստը:

Ինչպես Արմենպրեսին տեղեկացրին ՀՀ գլխավոր դատախազությունից, այսօր հրապարակած վճռում Եվրոպական դատարանը նշեց, որ այս գործով դատարանի խնդիրը չէ որոշելու՝ արդյոք Օսմանյան կայսրությունում 1915թ. հայ ժողովրդի նկատմամբ կատարված զանգվածային կոտորածներն ու տեղահանումները կարող են որակվել ցեղասպանություն` միջազգային իրավունքում այդ հասկացությանը տրված բովանդակության տեսանկյունից: Այնուհետև, դատարանի Մեծ պալատը սահմանեց, որ Եվրոպական դատարանը չունի որևէ իրավ ասություն` անելու իրավական հայտարարություններ այս հարցի վերաբերյալ՝ անկախ նրանից, թե որ տեսանկյունից է դա արվում:

Դատարանը վճռում նաև արձանագրեց, որ հայերն ունեն իրենց և իրենց նախնիների արժանապատվության նկատմամբ հարգանքի իրավունք, այդ թվում՝ այն շրջանակներում, որն առնչվում է ցեղասպանության հետևանքով վնաս կրած հայկական համայնքի ինքնությանը: Դատարանը նաև դրանով արձանագրեց, որ հայերի այդ համոզմունքները և դրա հետ կապված՝ նրանց արժանապատվությունը ենթակա են պաշտպանության կոնվենցիոն չափանիշների շրջանակներում:

Եվ վերջապես, Փերինչեքի հետ կապված կոնկրետ գործով Եվրոպական դատարանը սահմանեց, որ  նրան քրեական պատասխանատվության ենթարկելը ոչ թե ընդհանրապես հակասում է Եվրոպական դատարանի նախադեպային իրավունքին, այլ արձանագրեց, որ Փերինչեքի նկատմամբ սխալ է կիրառվել շվեյցարական օրենքը: Այսինքն՝ Հայոց ցեղասպանությունը ժխտելը քրեականացնելը և դրա համար քրեական պատասխանատվության ենթարկելը համարվել է իրավաչափ, որը, սակայն, պետք է արվի բացառապես Եվրոպական կոնվենցիայի շրջանակներում:

Արդյունքում, Հայաստանի կառավարության` Եվրոպական դատարան ներկայացված բոլոր պահանջները բավարարվեցին:
