ՀՀ դատախազությունը մերժել է Լևոն Զուրաբյանի հայտարարության հիման վրա քրեական գործի հարուցումը։  

ՀՀ դատախազության պաշտոնական կայքում տեղադրված  պարզաբանման մեջ նշված է.

«Հաշվի առնելով Սահմանադրական բարեփոխումների մասնագիտական հանձնաժողովի նախագահի կողմից Վենետիկի հանձնաժողովին կաշառք տալու մասին 2015 թվականի հոկտեմբերի 9-ին ՀՀ ԱԺ պատգամավոր Լևոն Զուրաբյանի  հայտարարության, նաև իրավապահ համակարգի կողմից դրան հաջորդած իրավական գործողությունների նկատմամբ հանրային մեծ հետաքրքրությունը, տեղեկացնում ենք. 

Լ.Զուրաբյանի հայտարարության կապակցությամբ ՀՀ ոստիկանության ԿՀԴՊ գլխավոր վարչությունում նյութերի նախապատրաստմամբ որևէ փաստական տվյալ ձեռք չի բերվել` Վենետիկի հանձնաժողովին կաշառք տալու և այդ հանձնաժողովի որևէ անդամի կողմից կաշառք ստանալու մասին, Լ. Զուրաբյանը չի ներկայացել ՀՀ ոստիկանության ԿՀԴՊ գլխավոր վարչություն, իր վերոհիշյալ հայտարարության շուրջ բացատրություն չի տվել և այն հիմնավորող որևէ փաստական տվյալ չի ներկայացրել, որը հիմք է տվել եզրակացնելու` Լ. Զուրաբյանի հայտարարությունը չի համապատասխանում իրականությանը, այսինքն՝ բացակայում են Վենետիկի հանձնաժողովին կաշառք տալու և, հետևաբար, նաև այդ հանձնաժողովի որևէ անդամի կողմից կաշառք ստանալու դեպքերը: 

Նախապատրաստված նյութերի ուսումնասիրության արդյունքում պարզվել է նաև, որ Լ. Զուրաբյանի հայտարարությունը չի պարունակում սուտ մատնության հանցակազմ՝ նկատի ունենալով, որ նրա արարքում բացակայում է տվյալ հանցագործության հանցակազմի սուբյեկտիվ կողմը (սուտ մատնության հանցակազմի սուբյեկտիվ կողմը բնութագրվում է ուղղակի դիտավորությամբ: Հանցանքը համարվում է ուղղակի դիտավորությամբ կատարված, եթե անձը գիտակցել է իր գործողության (անգործության)՝ հանրության համար վտանգավոր բնույթը, նախատեսել է հանրության համար դրա վտանգավոր հետևանքները և ցանկա ցել է դրանց  վրա հասնելը): 

Լ.Զուրաբյանի վերոհիշյալ ճեպազրույցի ուսումնասիրությունից պարզ է դարձել, որ վերջինս հետապնդել է ՀՀ-ում իրականացվող սահմանադրական բարեփոխումների գործընթացը, սահմանադրական բարեփոխումների մասնագիտական հանձնաժողովի նախագահին և Վենետիկի հանձնաժողովի անդամներին վարկաբեկելու նպատակ, և նրա  արարքում բացակայում է կաշառք տալու կամ կաշառք ստանալու մասին սուտ մատնության սուբյեկտիվ կողմի պարտադիր հատկանիշ հանդիսացող ուղղակի դիտավորությունը:

Այսպիսով, Լ. Զուրաբյանի հայտարարության առթիվ ՀՀ ոստիկանության ԿՀԴՊ գլխավոր վարչությունում նախապատրաստված նյութերով քրեական գործի հարուցումը մերժվել է՝ սահմանադրական բարեփոխումների նախագահի կողմից Վենետիկի հանձնաժողովին կաշառք տալու և այդ հանձնաժողովի որևէ անդամի կողմից կաշառք ստանալու դեպքերի բացակայության և Լ. Զուրաբյանի արարքում կաշառք տալու և կաշառք ստանալու մասին սուտ մատնություն կատարելու հանցակազմի բացակայության պատճառաբանությամբ»:
