Իրավական տեսանկյունից տրանսպորտային միջոցների ապակիների լուսաթափանցելիության արգելքի հետ կապված միջոցառումների իրագործման ժամանակ մի շարք հարցեր են ծագելու։ ՀՀ ՎԻՎՕ 123-րդ հոդվածի 4-րդ մասի համաձայն՝ ապակիների լուսաթափանցելիության չափի խախտմամբ ... տրանսպորտային միջոցները վարելը առաջացնում է տուգանքի նշանակում` սահմանված նվազագույն աշխատավարձի հիսնապատիկի չափով։ Նույն հոդվածի 5-րդ մասի համաձայն՝ ապակիների, ԱՐՏԱՔԻՆ ԹԱՂԱՆԹԱՊԱՏՈՒՄ ՈՒՆԵՑՈՂ ԱՊԱԿԻՆԵՐԻ լուսաթափանցելիության թույլատրելի չափերը, ինչպես նաև սույն հոդվածի չորրորդ մասի պահանջից բացառությունները սահմանում է Հայաստանի Հանրապետության կառավարությունը: ՀՀ կառավարության 24.02.2005թ. թիվ 289-Ն որոշմամբ հաստատված «Վերգետնյա տրանսպորտային միջոցներում օգտագործվող անվտանգ ապակիների տեխնիկական կանոնակարգի» 16-րդ կետի համաձայն՝ ավտոտրանսպորտային միջոցների հողմապակու լուսաթափանցելիությունը պետք է լինի 75 տոկոսից ոչ պակաս, առջևի դռների ապակիներինը, առջևի կողային ապակիներինը (առկայության դեպքում) և այլ ապակիներինը` 70 տոկոսից ոչ պակաս: Հետին տեսանելիության 2 հայելիների առկայության դեպքում այլ ապակիների լուսաթափանցելիությունը կարող է լինել 70 տոկոսից ցածր (Ի դեպ այս կանոնակարգն ընդունվել է ի կատարումն 1999թ. «Ստանդարտացման մասին» ՀՀ օրենքի, որն ուժը կորցրել է 24.03.2012 թվականին՝ համանուն նոր օրենքի ընդունմամբ)։ Նույն կանոնակարգի 48-րդ կետի համաձայն՝ սույն տեխնիկական կանոնակարգի պահանջներին ապակիների համապատասխանության պետական վերահսկողությունը պետք է իրականացվի «Համապատասխանության գնահատման մասին» Հայաստանի Հանրապետության օրենքով սահմանված կարգով։ «Համապատասխանության գնահատման մասին» Հայաստանի Հանրապետության օրենքի 1-3, 5-7 գլուխներն ուժը կորցրած են ճանաչվել և այս պահին գործում է միայն 4-րդ գլուխը, որը տեխնիկական կանոնակարգերի պահանջներին արտադրանքի, ծառայությունների համապատասխանության պետական վերահսկողություն իրականացնող է համարում ազգային մարմնին և ԳՅՈՒՂԱՏՆՏԵՍՈՒԹՅԱՆ ՈԼՈՐՏԻ պետական կառավարման լիազոր մարմնին։ Վերոհիշյալ նորմերի վերլուծությունից առնվազն հետևյալ հարցերն են ծագում՝ 1. Ո՞ր իրավական ակտում է սահմանված ԱՐՏԱՔԻՆ ԹԱՂԱՆԹԱՊԱՏՈՒՄ ՈՒՆԵՑՈՂ ԱՊԱԿԻՆԵՐԻ լուսաթափանցելիության չափերը, քանի որ ՀՀ ՎԻՎՕ 123-րդ հոդվածի 5-րդ մասում խոսվում է երկու տեսակի՝ ապակիների և արտաքին թաղանթապատում ունեցող ապակիների մասին։ ՀՀ կառավարության 24.02.2005թ. թիվ 289-Ն որոշմամբ սահմանվել է միայն ապակիների լուսաթափանցելիության «չափերը»։ 2. «Համապատասխանության գնահատման մասին» Հայաստանի Հանրապետության օրենքով սահմանված ո՞ր մարմինը պետք է իրականացնի վերահսկողությունը և ի՞նչպես։ Հիշեցում։ ՀՀ Սահմանադրության 42-րդ հոդվածի համաձայն՝ ոչ ոք չի կարող կրել պարտականություններ, որոնք սահմանված չեն օրենքով:
