Հայաստանում սեռով պայմանավորված հղիության արհեստական ընդհատումը կարգելվի օրենքով

Հայաստանում օրենքով կարգելվի հղիության՝ սեռով պայմանավորված արհեստական ընդհատումը:

ՀՀ կառավարությունն Ազգային ժողովի քննարկմանն է ներկայացրել «Մարդու վերարտադրողական առողջության եւ վերարտադրողական իրավունքների մասին» ՀՀ  օրենքում փոփոխություն կատարելու մասին, «Վարչական իրավախախտումների վերաբերյալ» ՀՀ օրենսգրքում լրացումներ օրենքների նախագծերի փաթեթը, որով առաջարկվում է արգելել սեռով պայմանավորված հղիության ընդհատումը:

Որպես հիմնավորում նշվում է այն հանգամանքը, որ ՄԱԿ-ի Բնակչության հիմնադրամի տվյալներով ծնունդների բնականոն  սեռային հարաբերակցություն է համարվում 102-106 տղա յուրաքանչյուր 100 աղջիկ նորածինների հաշվով: Մինչդեռ «Նորածինների սեռերի անհամամասնությունը Հայաստանում. ժողովրդագրական տվյալներ եւ վերլուծություն» հետազոտության տվյալների համաձայն` Հայաստանում այս հարաբերակցությունը էականորեն խախտված է, ինչը ի հայտ է եկել դեռեւս 1990-ական թվականներին: Նման անհամամասնության ձեւավորումը պայմանավորված է ինչպես հայ հասարակության մեջ տղա երեխային նախապատվություն տալու, ընտանիքում եւ հասարակությունում տղայի դերի եւ նշանակության մասին ձեւավորված պատկերացումների հետ, այնպես էլ բժշկական տեխնոլոգիաների զարգացման արդյունքում ապագա երեխայի սեռը պարզելու հնարավորության ստեղծմամբ: Ծնունդների բնականոն համարվող սեռային հարաբերակցության շեղումները ներկայում ՀՀ-ում վտանգավոր սահմանագծի են հասել եւ դարձել լուրջ ժողովրդագրական սպառնալիք: 2011 թվականի դրությամբ այն կազմել է 114 տղա նորածին՝ յուրաքանչյուր 100 աղջիկ նորածինների հաշվով։ Այս ցուցանիշով Հայաստանը հայտնվել է սեռով պայ մանավորված հղիության ընդհատման վատագույն ցուցանիշներ ունեցող երկրների շարքում (Չինաստան, Հնդկաստան, Ադրբեջան, Ալբանիա): Ավելին, երրորդ եւ հաջորդ երեխաների դեպքում այդ ցուցանիշը շատ ավելի բարձր է (2008-2012թթ. միջին ցուցանիշը կազմել է` 164 տղա 100 աղջկա դիմաց): Խնդիրը հատկապես արտահայտված է մարզերում (Գեղարքունիք, Արագածոտն, Արմավիր): Ծնունդների նման սեռային հարաբերակցության հետագա շարունակման դեպքում կանխատեսվում է գենդերային խզում, որի արդյունքում  մինչեւ 2060 թվականը չեն ծնվի 92932 աղջիկներ, ինչն էլ իր հերթին կբերի ծնունդների թվի առավել կրճա տման,  եւ որպես հետեւանք բնակչության թվաքանակի նվազման:

Օրենսդրական փաթեթով առաջարկվում է օրենսդրորեն արգելել սեռով պայմանավորված հղիության ընդհատումները, սահմանել հղիության արհեստական ընդհատումների կրճատմանն ուղղված օրենսդրական  լրացուցիչ կարգավորումներ եւ մեխանիզմներ:

Ըստ ներկայացուցչական ազգային հետազոտության տվյալների, ՀՀ-ում 2010 թվականին գրանցված հղիությունների 29% ավարտվել են  հղիության արհեստական ընդհատումներով, որոնցից մոտ 4,2% եղել են պայմանավորված երեխայի սեռով: Ներկայացված նախագծով նախատեսվում է սեռով պայմանավորված հղիության ընդհատումների արգելքը օրենքով ամրագրելու, ինչպես նաեւ  այլ օրենսդրական լրացուցիչ կարգավորումների եւ մեխանիզմների սահմանմամբ եւ դրանց կիրառմամբ կանխարգելել  հղիության չհիմնավորված արհեստական ընդհատումները, ինչի արդյունքում նախատեսվում է բարելավել ոլորտում գրանցված ցուցանիշները:
