Երևան քաղաքի Կենտրոն և Նորք-Մարաշ վարչական շրջանների ընդհանուր իրավասության դատարանը, դատավոր Ա.Սուքոյանի նախագահությամբ, դռնբաց դատական նիստում քննության առնելով քաղաքացիական գործն ըստ դիմումի «Հայաստանի Էլեկտրական ցանցեր» ՓԲԸ-ի` ընդդեմ «Գլենդել Հիլզ» ՓԲԸ-ի, որոշել է սնանկ ճանաչել «Գլենդել Հիլզ» ՓԲԸ-ին:

Ըստ գործի դատավարական նախապատմության՝ «Հայաստանի էլեկտրական ցանցեր» ՓԲԸ-ն, դիմելով դատարան, խնդրել է պատասխանող «Գլենդել Հիլզ» ՓԲԸ-ին ճանաչել սնանկ: Երևան քաղաքի Կենտրոն և Նորք-Մարաշ վարչական շրջանների ընդհանուր իրավասության դատարանի 05.05.2015թ. որոշմամբ՝ քաղաքացիական գործն ընդունվել է վարույթ և սնանկության գործով ժամանակավոր կառավարիչ է նշանակվել Կարեն Ասատրյանը: «Գլենդել Հիլզ» ՓԲԸ-ն գրավոր առարկություններ է ներկայացրել դատարան «Հայաստանի էլեկտրական ցանցեր» ՓԲԸ-ի կողմից ներկայացված դիմումի դեմ: «Հայաստանի էլեկտրական ցանցեր» ՓԲԸ-ն դատարան ներկայացրած դիմումով հայտնել է, որ Երևան քաղաքի Մալաթիա-Սեբաստիա վարչական շրջանների ընդհանուր իրավասության դատարանի կողմից թիվ ԵՄԴ/0617/02/13 քաղաքացիական գործով 03.04.2014թ. կայացված վճռի համաձայն՝ Գլենդել Հիլզ» ՓԲԸ-ից հօգուտ դիմումատու «Հայաստանի էլեկտրական ցանցեր» ՓԲԸ-ի ընդհանուր առմամբ ենթակա է բռնագանձման 137.428.776 ՀՀ դրամ:

Նշված գործով պարտապանի կողմից ներկայացվել է վերաքննիչ բողոք, որը ՀՀ վերաքննիչ քաղաքացիական դատարանի 10.09.2014թ. որոշմամբ մերժվել է և վճիռը 13.11.2014թ. ստացել է օրինական ուժ: «Հայաստանի էլեկտրական ցանցեր» ՓԲԸ-ն հայտնել է, որ պարտապան «Գլենդել Հիլզ» ՓԲԸ-ի անվիճելի վճարային պարտավորությունը կազմում է 137.428.776 ՀՀ դրամ:

Դատաքննության ընթացքում դիմումատու «Հայաստանի էլեկտրական ցանցեր» ՓԲԸ-ի ներկայացուցիչ Դավիթ Հայրապետյանը ևս մեկ անգամ պնդել է իր իրավական դիրքորոշումը` հայտնելով, որ պարտապանի մոտ առկա են «Սնանկության մասին» ՀՀ օրենքի 3-րդ հոդվածի հիմքերը` փաստացի անվճարունակությունը, քանի որ պարտապանը թույլ է տվել օրենքով սահմանված նվազագույն աշխատավարձի հազարապատիկը գերազանցող անվիճելի վճարային պարտավորությունների 60 օր և ավելի ժամկետով կետանց, պարտապան «Գլենդել Հիլզ» ՓԲԸ-ի կողմից չի կատարվել անվիճելի վճարային պարտավորությունները և նշված կետանցը մինչև օրս շարունակվում է: «Հայաստանի էլեկտրական ցանցեր» ՓԲԸ-ի ներկայացուցիչ Դավիթ Հայրապետյանը ներկայացել է դատական նիստին և պաշտպանել է դիմողի իրավական դիրքորոշումը:

Վերոգրյալի հիման վրա և ղեկավարվելով «Սնանկության մասին» ՀՀ օրենքով 2-րդ, 3-րդ, 11-րդ, 13-րդ հոդվածներով և հաշվի առնելով այն հանգամանքը, որ պարտապանի պարտավորությունը անվիճելի է, «Հայաստանի էլեկտրական ցանցեր» ՓԲԸ-ն խնդրել է «Գլենդել Հիլզ» ՓԲԸ-ին ճանաչել սնանկ: Դատավարության օրենսգրքի 130-132-րդ հոդվածներով, դատարանը վճռել է. «Հայաստանի էլեկտրական ցանցեր» ՓԲԸ-ի դիմումն ընդդեմ «Գլենդել Հիլզ» ՓԲԸ-ի` պատասխանողին սնանկ ճանաչելու պահանջի մասին, բավարարել: «Գլենդել Հիլզ» ՓԲԸ-ին ճանաչել սնանկ: «Գլենդել Հիլզ» ՓԲԸ-ից հօգուտ «Հայաստանի էլեկտրական ցանցեր» ՓԲԸ-ի բռնագանձվելիք 500.000 ՀՀ դրամ պետական տուրքը, որպես դատական ծախսեր գրանցել «Սնանկության մասին» Հայաստանի Հանրապետության օրենքի 82-րդ հոդվածի 1-ին մասի «դ» հերթում, որը պետք է մարվի պարտապանի միջոցներից:
