Թե ինչու ազատ արձակվեց բժշկուհի Բախշյանը. հիմնավորում

Շուշանիկ Բախշյանի ազատ արձակման դատական որոշումը անհասկանալի կարող է թվալ հասարակությանը, ուստի, ստորև կներկայացնեմ իրավաբանական հիմքերը:
Քրեական դատավարության օրենսգրքի 128 հոդվածի համաձայն ձերբակալման ժամանակ անձի մեղավորության և այլ հարցեր չեն քննարկվում: Քննարկվում է միայն նրա փախուստի դիմելու-չդիմելու հարցը:
Եվ Շ.Բախշյանի հարցում դատարանը նույնպես քննարկել է միայն այդ հարցը: Ձերբակալման ապօրինի լինելը կայացել է հենց դրանում:
Բացի այդ, մի շատ կարևոր կետ հատկապես փաստաբանների և իրավապաշտպանների համար, որոնք տարիներ շարունակ պայքարել են մարդուն կալանավորելու, անվերջ կալանքը երկարաձգելու դեմ: Մինչև դատալսում մարդիկ երկար ժամանակ զրկված էին լինում ազատությունից եւ զրկանքներ կրում քրեակատարողական հիմնարկներում:
Նոր Սահմանադրության 27 հոդվածի 5-րդ մասի համաձայն ազատությունից զրկված յուրաքանչյուր ոք իրավունք ունի վիճարկելու իրեն ազատությունից զրկելու իրավաչափությունը, որի վերաբերյալ դատարանը սեղմ ժամկետում որոշում է կայացնում և կարգադրում է նրան ազատ արձակել, եթե ազատությունից զրկելը ոչ իրավաչափ է, ինչը եւ տեղի է ունեցել: Նախկինում նման ընթացակարգ չի եղել:
Եվ այո, Վարդան Պետրոսյանին էլ չէին կալանավորի մինչև դատարանի վճիռը, եթե այն ժամանակ գործեր Սահմանադրության այս փոփոխությունը:
