ՀՀ Արդարադատության նախարար Արփինե Հովհաննիսյանը ֆեյսբուքյան իր էջում գրում է.

Կառավարության հարց ու պատասխանի ժամանակ գործընկերջս՝ Ն. Զոհրաբյանի հնչեցրած հարցի հետքերով.. Չպահանջված գովազդային հաղորդագրությունների խնդիրը մինչ այս էլ գտնվել է ՀՀ արդարադատության նախարարության ուշադրության կենտրոնում, և Ազգային Ժողովում այս խնդրի մասին բարձրաձայնած պատգամավոր Նաիրա Զոհրաբյանի հայտարարությունը ևս մեկ առիթ էր, որպեսզի ԱՆ Անձնական տվյալների պաշտպանության գործակալությունն ուսումնասիրի xopan.am-ից բջջային հեռախոսահամարներին ստացված հաղորդագրության իրավաչափությունն ու դրա վերաբերյալ ներկայացնի իր խորհրդատվական որոշումը: Նշեմ, որ տվյալ դեպքում խոսքը գնում է «ուղղակի մարքեթինգի» մասին:

Հաշվի առնելով, որ անցանկալի գովազդային հաղորդագրություններ փոխանցելը միջամտություն է մարդու անձնական կյանքին և որ ցանկացած դեպքում մարդու անձնական տվյալները, այդ թվում՝ անձնական հեռախոսահամարը, պետք է օգտագործվեն բացառապես անձի համաձայնությամբ կամ օրենքով ուղղակիորեն նախատեսված դեպքում՝ ակնհայտ է դառնում, որ տվյալ պարագայում խախտվել է «Անձնական տվյալների պաշտպանության մասին» ՀՀ օրենքը:

Չնայած այս դեպքում հաղորդագրությունն ուղարկվել էր մարքեթինգ իրականացնող մասնավոր կազմակերպության կողմից, այնուամենայնիվ, նման դեպքերը բացառելու գործում շատ եմ կարևորում կապի ծառայություն մատուցող օպերատորների դերը և ակնկալում, որ էլեկտրոնային հաղորդակցության ծառայություն մատուցող բոլոր կազմակերպությունները (կամ օպերատորները) կձեռնարկեն անհրաժեշտ և առավելագույն կազմակերպչական, տեխնիկական (ծրագրային) միջոցներ՝ կանխելու համար առանց իրենց բաժանորդների համաձայնության այլ անձանց կողմից ուղղակի մարքեթինգի նպատակով բաժանորդների անձնական տվյալների օգտագործումը և որ էլեկտրոնային հաղորդակցության ծառայություն մատուցելու վերաբերյալ բաժանորդների հետ կնքվող պայմանագրերում կնախատեսեն ուղղակի մարքեթինգի նպատակով բաժանորդի անձնական տվյալներն, այդ թվում՝ հեռախոսահամարն օգտագործելու վերաբերյալ դրույթներ: Այլապես, վերջիվերջո խնդիր է առաջանալու օպերատորի և հաճախորդի միջև։
