Երբ փոստատան աշխատակիցը հափշտակել է իրականում գոյություն ունեցող, այսինքն՝ մեռած հոգի չհանդիսացող որոշակի անձանց թոշակներն ու նպաստները, կարծում ենք, նա շատ լավ պատկերացրել է, որ դա անպայման բացահայտվելու է և ինքը չի կարողանալու խույս տալ պատասխանատվությունից: Եվ այնուհանդերձ…

Ըստ մեղադրական եզրակացության՝ «Հայփոստ» ՓԲԸ-ի թիվ 0054/1 փոստային բաժանմունքի օպերատոր, նյութական պատասխանատու անձ Ամալյա Գրիգորյանն ուրիշի առանձնապես խոշոր չափի գույքը հափշտակելու դիտավորությամբ 2015թ. սեպտեմբեր-հոկտեմբերին, տարբեր օրերի ընթացքում, թվով 53 քաղաքացիներին կենսաթոշակ և նպաստ վճարելու համար իրեն հանձնված գումարներից յուրացման եղանակով հափշտակել է ընդհանուր 4 մլն 244 610 դրամ՝ «Հայփոստ» ՓԲԸ-ին պատճառելով առանձնապես խոշոր չափի գույքային վնաս: Համաձայն քրգործի նյութերի՝ Ա. Գրիգորյանն այս գործողությունը կատարել է համապատասխան ցուցակներում նշված քաղաքացիների փոխարեն կեղծ ստորագրություններ դնելով:

Վերը նշված արարքի համար Ամալյա Գրիգորյանին մեղադրանք է առաջադրվել ՀՀ քրեական օրենսգրքի 179-րդ հոդվածի («Յուրացնելը կամ վատնելը») 3-րդ մասի 1-ին կետի և 325-րդ հոդվածի («Փաստաթղթեր, դրոշմներ, կնիքներ, ձևաթղթեր, տրանսպորտային միջոցների պետհամարանիշներ կեղծելը, իրացնելը կամ օգտագործելը») 1-ին մասի հատկանիշներով: Նշված հոդվածներից միայն առաջինի 3-րդ մասով նախատեսված է 5-8 տարի ազատազրկում:

Անշուշտ, նպատակ չունենք արդարացնել այս արարքը՝ նկատի ունենալով նաև, թե ում գումարներն է, ըստ մեղադրական եզրակացության, հափշտակել փոստատան աշխատակիցը: Սակայն միաժամանակ հասկանալի է, որ կյանքի հանգամանքների բերումով (օրինակ՝ իր կամ մերձավորի վիրահատության հետ կապված և այլն) Ա. Գրիգորյանը գումարի սուր կարիք է ունեցել, չի կարողացել գտնել ֆինանսական միջոցներ ձեռք բերելու այլ ճանապարհ, այլապես թոշակառուների և նպաստառուների ստանալիք մոտ 5 մլն դրամը չէր հափշտակի՝ աչքի առաջ ունենալով բռնվելու հեռանկարը: Իսկ ե՞րբ են բռնվելու և դատվելու այն մարդիկ, ովքեր հափշտակում, յուրացնում են ծանր վիճակում չլինելով, փողի սուր կարիք չունենալով, ընդ որում, ոչ թե 5, այլ 50 կամ 500 մլն դրամի կարգի գումարներ:
