ՊԵԿ-ի պարզաբանումն ORER.am-ի հոդվածին նոր հարցադրումներ է առաջացնում

Orer.am-ի՝ մայիսի 10-ին հրապարակված «Ո՞ւր է նայում ՊԵԿ նոր ղեկավար Հովիկ Հովսեփյանը» հոդվածում անդրադարձել էինք ՊԵԿ Մաշտոցի հարկային տեսչության կողմից «Տրանս-սֆեր» ՍՊԸ-ին հարկային պարտավորությունների վերաբերյալ մեկ օր տարբերությամբ տրված իրար հակասող երկու տեղեկանքներին, որի պատճառով ընկերությունը զրկվել էր պետգնումների գործընթացին մասնակցելու իրավունքից:

ՊԵԿ-ը, արձագանքելով Orer.am-ի հոդվածին, մանրամասն պարզաբանում է ներկայացրել, որտեղ նշված է, որ «Տրանս-Սֆեր» ՍՊԸ-ի 25.03.2016թ. ներկայացված դիմումին ի պատասխան Մաշտոցի հարկային տեսչությունը մարտի 21-ի և 22-ի դրությամբ հարկային մարմնի կողմից տրված տեղեկանքներից առաջինով տեղեկացրել է, որ ընկերությունը 21.03.2016-ի դրությամբ 992605 դրամ ընդհանուր պարտավորություն է ունեցել, որից եկամտային հարկը կազմել է 877474 դրամ, իսկ սոցիալական վճարը՝ 115131 դրամ: Քանի որ սոցիալական վճարը չի համարվում հարկային պարտավորություն, ուստի այդ պատճառով էլ այն չի ներառվել նախորդ կետում նշված եզրակացության մեջ:

ՊԵԿ-ի պարզաբանման մեջ նշված է նաև, որ մեկ օր անց տրված գրության համաձայն՝ 22.03.2016թ. դրությամբ, Մաշտոցի հարկայինը նույն ընկերության մասով տրված տեղեկանքում նշել է, որ ընկերությունը պարտք չունի, քանի որ հարկ վճարողը նշված պարտավորությունները վճարել (մարել) է նույն օրը` 22.03.2016թ.:

«Ելնելով վերոգրյալից՝ հայտնվում է, որ «Տրանս-Սֆեր» ՍՊԸ-ն հայտի ներկայացման օրը` 21.03.2016թ., ունեցել է ժամկետանց հարկային պարտավորություններ և հարկային մարմնի կողմից ներկայացված եզրակացությունը, այնուհետև նաև Մաշտոցի ՀՏ-ի տեղեկանքը կազմված են ճիշտ, հետևապես վերոգրյալ հոդվածում ներկայացված տեղեկությունները չեն համապատասխանում իրականությանը»:

Ի դեպ, ՊԵԿ-ի պատասխանը նոր հարցադրումներ է առաջացնում, որին ավելի մանրամասն կանդրադառնանք առաջիկայում: Այս պահին միայն նշենք, որ «Տրանս-Սֆեր» ՍՊԸ-ն միակ կազմակերպությունը չէ, որը հարկային մարմինների կողմից տրված հարկային պարտավորությունների մասին իրականության հետ բոլորովին կապ չունեցող տեղեկություն է տրամադրում գնումների գործընթացին մասնակցող ընկերությունների մասին, որի պատճառով էլ այլ ընկերությունները դուրս են մնում պետգնումների գործընթացից: Ամենայն հավանականությամբ, խնդրի արմատներն ավելի խորն են, քան կարելի է եզրակացնել և իրականում լուրջ մտահոգություն ունենք, որ աշխատանքային այս ոճով հարկայինի թեթև ձեռքով պետական գնումների գործընթացից «մաքրվում են» այսպես ասած անցանկալի կազմակերպությունները:

Ի դեպ, հեռու ենք նաև այն մտքից, որ հարկային պարտավորությունները պատշաճ չկատարող որևէ ընկերություն իրեն թույլ կտա մասնակցել գնումների գործընթացին` լավ իմանալով, թե ինչ փաստաթղթեր պետք է ներկայացնել և դրանից զատ ինչ հարցումներ են կատարվելու տվյալ ընկերության վերաբերյալ: Այնպես որ, իրականում խնդիրն ավելի խորքային է, քան թվում է առաջին հայացքից, ուստի ժամանակն է պարզունակ պատասխանների փոխարեն խնդիրներին մոտենալ նաև այդ տեսանկյունից:
