Գյումրիում կշարունակվի Վալերի Պերմյակովի գործով հերթական դատական նիստը

 Գյումրիում տեղակայված 102-րդ ռազմաբազայի տարածքում հուլիսի 8-ին կշարունակվի Վալերի Պերմյակովի գործով հերթական դատական նիստը. Ավետիսյանների շահերի պաշտպանները ներկայացնելու են դատավորի ինքնաբացարկի միջնորդություն: Այդ միջնորդությանը պատրաստվելու նպատակով Ավետիսյանների իրավահաջորդների շահերի պաշտպան, փաստաբան Լուսինե Սահակյանը, հունիսի 30-ին կայացած դատական նիստին  դատարանից 1 շաբաթ ժամանակ պահանջեց: Ըստ Ավետիսյանների շահերի պաշտպանների՝ ինքնաբացարկի միջնորդության համար հիմք հանդիսացել է  Շիրակի մարզի առաջին ատյանի դատարանի կողմից՝ դատը նախահագող դատավոր Հարություն Մովսիսյանի կայացրած որոշումը՝ չընդունել նախորդ՝ մայիսի 27-ին ներկայացված քաղհայցն ընդդեմ ՌԴ-ի: Այս որոշումն, ըստ փաստաբանների, ակնհայտ անհիմն է, քանի որ անցած նիստին դատարանը ոչ միայն ընդունել է, այլ նաև ՌԴ-ին ճանաչել քաղհայցվոր: Ավելին՝ 1 ամսով դատը հետաձգել է հայցը թարգմանելու ու հասցեատիր ոջը ներկայացնելու համար, իսկ հունիսի 30-ին արդեն որոշել է՝ չընդունել այդ հայցը:

Քաղհայցը կազմվել է հաշվի առնելով բազմաթիվ միջազգային  օրինագծեր՝ նկատի ունենալով հասցված բարոյական մեծ վնասը: Քաղհայցի չափը որոշվել է հաշվի առնելով մի շարք հանգամանքներ՝ այդ թվում, որ Պերմյակովի կողմից իրականացրած սպանությունների հետևանքով մահացել են Ավետիսյանների ընտանիքի 7 անդամները, նրանցից 2-ը` մանկահասակ երեխա:

«Հաշվի առնելով պատճառած բարոյական վնասը,  ոչ նյութական վնասի հատուցման չափ պետք է սահմանել ընտանիքի յուրաքանչյուր չափահաս անդամի մասով 50 հազար եվրոյին համարժեք ՀՀ դրամի չափով, իսկ մանկահասակ յուրաքանչյուր երեխայի մասով 100 հազար եվրոյին համարժեք դրամով: Ելնելով վերոնշյալից՝ պահանջում ենք ՌԴ-ից բռնագանձել հօգուտ Լուսինե Ավետիսյանի՝ 100 հազար եվրոյին համարժեք ՀՀ դրամ, հօգուտ՝ Անահիտ Կոշտոյանի՝ 100 հազար եվրոյին համարժեք ՀՀ դրամ, հօգուտ  Անդրանիկ Պողոսյանի՝ 125 հազար եվրոյին համարժեք ՀՀ դրամ« հօգուտ Մարինե Պողոսյանի 125 հազա ր եվրոյին համարժեք ՀՀ դրամ՝ որպես Աիդա, Հասմիկ, Սերյոժա և Արմեն Ավետիսյանների, Արաքսյա Պողոսյանի և մանկահասակ Հասմիկ և Սերյոժա Ավետիսյանների սպանության հետևանքով պատճառած ոչ նյութական վնասի փոխհատուցում»,-նշված է քաղհայցի մեջ:

Ավետիսյանների ընտանիքի 6 անդամների սպանությունը տեղի է ունեցել 2015 թվականի հունվարի 12-ին՝ վաղ առավոտյան ժամը 06:00-ի սահմաններում  նրանց մահը վրա է հասել հրազենային վնասվածքներից։ Ավետիսյանների ընտանիքից ողջ էր մնացել 6 ամսական փոքրիկը՝ Սերյոժա Արմենի Ավետիսյանը, ով կտրող-ծակող գործիքից ստացած վնասվածքներով տեղափոխվել էր բժշկական կենտրոն,  այնուհետև` յոթ օր հետո մահացել: Կասկածյալին ռուս սահմանապահները հայտնաբերել են հայ-թուրքական սահմանը հատելու փորձ կատարելիս եւ հանձնել 102-րդ ռուսական բազայի հրամանատարությանը:

Քրեական գործը հարուցվել է ՀՀ քրեական օրենսգրքի 104-րդ հոդվածի 2-րդ մասի 1-ին կետով (երկու և ավելի անձանց սպանությունը): ՀՀ քննչական կոմիտեի քննիչները Վալերի Պերմյակովին  մեղադրանք են առաջադրել ՀՀ ՔՕ 104-րդ հոդվածի 2-րդ մասի 1-ին կետով՝ երկու եւ ավելի անձանց դիտավորյալ սպանության համար: Վալերի Պերմյակովն ընդունել է առաջադրված մեղադրանքը:

Ռուսական կողմում հարուցված քրեական գործով Պերմյակովը դասալքության եւ զենքի ապօրինի կրման համար օգոստոսի 12-ին դատապարտվել է 10 տարվա ազատազրկման:
