Ոստիկանության ծառայողների նկատմամբ բռնություն կիրառելու դեպքի առթիվ հարուցվել է քրեական գործ

 ՀՀ քննչական կոմիտեի Երևանի քննչական վարչությունում 2016 թվականի հուլիսի 20-ին ոստիկանությունից նյութեր են ստացվել՝ ոստիկանության տարբեր ծառայողներին պատճառված մարմնական վնասվածքների վերաբերյալ։ Այս մասին  տեղեկացրին ՀՀ քննչական կոմիտեի դեպարտամենտի տեղեկատվության և հասարակայնության հետ կապերի բաժնից:

Նախապատրաստված նյութերի ուսումնասիրությամբ պարզվել է, որ 2016 հուլիսի 19-ին՝ ժամը 20-ի սահմաններում, Երևան քաղաքի Մ.Խորենացի փողոցին հարող Գլինկայի և Որմնադիրների փողոցների հատման վայրում մի խումբ անձինք բռնություն են գործադրել իրենց ծառայողական պարտականությունները կատարող ոստիկանության ծառայողների նկատմամբ՝ քարեր և այլ կոշտ առարկաներ նետելով նրանց ուղղությամբ։ Կիրառված բռնությունների հետևանքով տարբեր մարմնական վնասվածքներով բուժօգնության է տեղափոխվել ոստիկանության 6 աշխատակից։

Նկատի ունենալով, որ նյութերն առերևույթ պարունակում են ՀՀ քրեական օրենսգրքի 316-րդ հոդվածի 2-րդ մասով նախատեսված հանցագործության հատկանիշներ, այն է՝ իշխանության ներկայացուցչի նկատմամբ առողջության համար վտանգավոր բռնությունը՝ կապված նրանց կողմից իրենց ծառայողական պարտականությունները կատարելու հետ, Երևանի քննչական վարչությունում հարուցվել է քրեական գործ։ Կազմվել է քննչական-օպերատիվ խումբ։

Ոստիկանության 6 ծառայողներ ճանաչվել են որպես տուժող և հարցաքննվել։ Քրեական գործի նախաքննության ընթացքում ներբեռնվել և ուսումնասիրվել են դեպքի վերաբերյալ համացանցում առկա տեսագրությունները և հանձնարարություն է տրվել ոստիկանության համապատասխան ստորաբաժանումներին միջոցներ ձեռնարկել՝ ոստիկանության աշխատակիցներին մարմնական վնասվածքներ պատճառած, տեսանյութերում պատկերված անձանց ինքնությունը պարզելու, հայտնաբերելու և վարույթն իրականացնող մարմնին ներկայացնելու ուղղությամբ։

Ձեռնարկվում են անհետաձգելի քննչական գործողություններ՝ դեպքի բոլոր հանգամանքների բազմակողմանի, օբյեկտիվ և լրիվ հետազոտումն ապահովելու ուղղությամբ։

Ծանուցում. Ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
