Ավետիսյանների սպանության գործ. պաշտպանական կողմը միացավ տուժողի իրավահաջորդի միջնորդությանը

Գյումրիում Ավետիսյանների ընտանիքի սպանության գործով դատական նիստին այսօր՝  օգոստոսի 5-ին, տուժողի իրավահաջորդ Արթուր Սաքունցը սպանված Ավետիսյանների տանը քննչական փորձարարություն կատարելու միջնորդություն ներկայացրեց, նաեւ սպանության օրը հնչած կրակոցի ձայնի ուժգնությունը չափելու միջնորդություն՝ պարզելու դեպքի հանգամանքները:

Նշենք, որ ըստ Քրեական դատավարության օրենսգրքի՝ փորձաքննվողի համաձայնությամբ միայն կարող է կատարվել փորձարարություն: Պերմյակովը հրաժարվեց մասնակցել փորձարարությանը եւ դատարանն այդ պատճառաբանությամբ մերժեց  միջնորդությունը:

Տուժողի իրավահաջորդ Արթուր Սաքունցը նաեւ միջնորդությամբ հանդես եկավ՝ անթույլատրելի ճանաչել  ռուսական կողմի ձեռք բերած բոլոր ապացույցները, պատճառաբանելով, որ եղել են երկու քրեական գործեր եւ ռուսական  կողմն իրավունք չուներ քրեական գործ հարուցելու եւ եթե այդ  ապացույցները ձեռք են բերվել այդ քրեական գործի շրջանակում, ուստի ռուսական կողմի ձեռք բերած ապացույցները պետք է  ճանաչվեն անթույլատրելի:

Տուժողի մյուս իրավահաջորդներն ու դատախազը առարկեցին միջնորդության դեմ՝ նշելով, որ այդ ապացույցները ձեռք են բերվել օրենքով սահմանված  կարգով եւ չեն կարող ճանաչվել անթույլատրելի: Այս  միջնորդությանը, սակայն, միացավ  պաշտպանական կողմը՝  Պերմյակովն ու նրա պաշտպանը, նշելով, որ քանի որ դա Պերմյակովի շահերից է բխում,  ուստի միանում են միջնորդությանը եւ խնդրում, որ այդ ապացույցներն անթույլատրելի ճանաչվեն:

Դատարանը հեռացավ խորհրդակցական սենյակ: Հաջորդ դատական նիստը տեղի կունենա օգոստոսի 12-ին:

Մեղադրական եզրակացության համաձայն՝ 2015-ի հունվարի 12-ին Գյումրիի ռուսական ռազմակայանի զինծառայող Վալերի Պերմյակովը մտել է Ավետիսյանների ընտանիքի տուն ու սպանել տան բնակիչներ Աիդա Ավետիսյանին, Հասմիկ Ավետիսյանին, Սերյոժա Ավետիսյանին, Արմեն Ավետիսյանին, Արաքսյա Պողոսյանին ու փոքրիկ Հասմիկ Ավետիսյանին: Հետո նա դանակով հինգ հարված է հասցրել 6-ամսական Սերյոժա Ավետիսյանին: Յոթ օր անց երեխան մահացել էր հիվանդանոցում:
