ԿԽՄԿ-ն նրբանկատորեն հերքել է Ադրբեջանի օմբուդսմենի հայտարարությունը

Կարմիր խաչի միջազգային կոմիտեն նրբանկատորեն հերքել է  Ադրբեջանի օմբուդսմեն Էլմիրա Սուլեյմանովայի հայտարարության մասին «ԱՊԱ» գործակալության հրապարակումը։

Դեկտեմբերի 9-ի հրապարակման մեջ ԱՀ օմբուդսմենը վստահեցնում է, որ «հանդիպել ու քննարկումներ է անցկացրել ԿԽՄԿ ղեկավարի հետ՝ Հայաստանում ազատազրկված Դիլգամ Ասկերովի ու Շահբազ Գուլիևի մասին։ Մեզ ասել են, որ ապօրինի դատավարությամբ Դիլգամին ու Շահբազի համար վճռված պատիժը չի համապատասխանում միջազգային իրավունքի նորմերին ու հակասում է դրանց»։

Փաստորեն, Էլմիրա Սուլեյմանովան հավաստիացնում էր, որ ԿԽՄԿ նախագահը խոսել է «ապօրինի դատավարության» ու « միջազգային իրավունքի նորմերին չհամապատասխանող պատժի մասին»։

Այս հրապարակման կապակցությամբ ԿԽՄԿ մեկնաբանության մեջ ասվում է․

«Կարմիր խաչի միջազգային կոմիտեն (ԿԽՄԿ) երբեք չի արտահայտվում ազատազրկման պատճառների, կալանավորման իրավական հիմքերի և դատավճռի իրավասության վերաբերյալ: ԿԽՄԿ-ն նաև չի զբաղվում ազատազրկված անձանց ազատ արձակելու հարցերով: Մեր հիմնական առաքելությունն է՝ բոլոր ազատազրկվածների համար ապահովել մարդկային վերաբերմունք, ազատազրկման արժանապատիվ պայմաններ և կապ ընտանիքի հետ:

Ժնևի կոնվենցիաներն առավել լայն ճանաչված և ընդունված միջազգային պայմանագրերն են, որոնք կարգավորում են զինված հակամարտության կողմերի պարտավորությունները։ Դրանք նաև հանդիսանում են իրավական հիմք՝ ԿԽՄԿ-ի գործունեության համար: Ժնևի կոնվենցիաները չեն տրամադրում դատական անձեռնմխելիություն պաշտպանության ներքո գտնվող անձանց։ Դրանցով սահմանվում է դատավարական երաշխիքների ապահովման անհրաժեշտությունը:»
