Դատավորի կողմից փաստաբանի միջնորդությամբ խոշոր չափերով կաշառք ստանալու վերաբերյալ քրեական գործով առաջին դատական նիստի ընթացքում ամբաստանյալի պաշտպանների կողմից ՀՀ գլխավոր դատախազության հատկապես կարևոր գործերով քննության վարչության պետի տեղակալ Կարեն Բիշարյանի՝ որպես պատշաճ մեղարդող հանդես գալու հանգամանքը վիճարկելու վերաբերյալ ՀՀ գլխավոր դատախազությունը տեղեկացնում է, որ նախագա հող դատավորի կողմից չեն ընդունվել պաշտպանների փաստարկները:

Խնդրի առնչությամբ ՀՀ գլխավոր դատախազության տարածած պարզաբանման մեջ մասնավորապես նշվում է.

«Այդուհանդերձ, նկատի ունենալով հարցի հանրային հնչեղությունը, հարկ ենք համարում պարզաբանել. ՀՀ «Դատական օրենսգրքի» 13-րդ հոդվածը, ամրագրելով դատավորի անձեռնմխելիության երաշխիքները, որպես այդպիսին նախատեսել է նաև դատավորի նկատմամբ քրեական հետապնդում հարուցվելու դեպքերում քրեական գործով նախաքննության օրինականության նկատմամբ հսկողության հատուկ կարգ: Մասնավորապես, հիշյալ հոդվածի 4-րդ մասի համաձայն՝ «4. Դատավորի նկատմամբ քրեական հետապնդում հարուցելու պահից տվյալ գործով մինչդատական վարույթի նկատմամբ դատախազական հսկողությունն իրականացնում է Հայաստանի Հանրապետության գլխավոր դատախազը:»:

ՀՀ գլխավոր դատախազի կողմից է հաստատվել քրեական գործով կազմված մեղադրական եզրակացությունը և քրեական գործը մեղադրական եզրակացությամբ ուղարկվել դատարան: Նշված քրեական գործով դատավորի նկատմամբ քրեական հետապնդում հարուցվելու պահից քրեական գործով նախաքննության օրինականության նկատմամբ հսկողությունն իրականացվել է ՀՀ գլխավոր դատախազի կողմից:

Ինչ վերաբերում է դատարանում մեղադրանքի պաշտպանությանը, ապա քրեական գործով ՀՀ գլխավոր դատախազի կողմից հիշյալ դատարանի նախագահին հասցեագրված գրությամբ հայտնվել է, որ «Դատախազության մասին» ՀՀ օրենքի 26-րդ հոդվածի 1-ին մասով սահմանված կարգով ՀՀ գլխավոր դատախազության հատկապես կարևոր գործերով քննության վարչության պետի տեղակալ Կարեն Բիշարյանը ներգրավվել է ՀՀ քրեական օրենսգրքի 311-րդ հոդվածի 4-րդ մասի 3-րդ կետով մեղադրվող Ի.Բարսեղյանի և նույն օրենսգրքի 313-րդ հոդվածի 1-ին մասով մեղադրվող Է. Զաքարյանի վերաբերյալ քրեական գործով մեղադրանքը պաշտպանող դատախազի դատավարական լիազորությունների իրականացմանը, ինչից հստակ հետևում է, որ Կ. Բիշարյանը տվյալ քրեական գործով միակ մեղադրողը չէ, հետևաբար ՀՀ գլխավոր դատախազը ոչ թե հիշյալ քրեական գործով իր լիազորությունները վերապահել է Կ. Բիշարյանին, այլ վերջինս քրեական գործով որպես մեղադրող է ներգրավվել «Դատախազության մասին» ՀՀ օրենքի պահանջներին համապատասխան, ուստի որևէ իրավական հիմնավորմամբ չի կարող վիճարկվել տվյալ քրեական գործով Կ.Բիշարյանի՝ որպես պատշաճ մեղադրող հանդես գալու հանգամանքը»:
