Ապօրինի կերպով ծառայության չներկայանալու մեղադրանքով 2.5 տարվա ազատազրկման դատապարտված «Վարդաշեն» ՔԿՀ-ում գտնվող սպա Ցոլակ Խաչատրյանը նշում է` իր գործում նոր երեւան եկած հանգամանք կա: NEWS.am-ի խմբագրություն զանգահարած դատապարտյալը պատմեց, որ իրեն ազատազրկման են դատապարտել` ապօրինի կերպով ծառայության չներկայանալու համար, սակայն, այդ ժամանակ պայմանագիրը, որով պարտավոր է եղել ծառայել ՀՀ զինված ուժերում, օրինական ուժը կորցրած է եղել եւ նա պարտավորություններ չի ունեցել:

«Ես սպա եմ եղել, յուրաքանչյուր սպա հանդիսանում է պայմանագրային զինծառայող, այստեղ պարտադիր հանգամանք է օրինական ուժը չկորցրած պայմանագրի առակայությունը: Ինձ մոտ այդպիսի պայմանագիր չի եղել, որով ես պարտավորված եմ եղել ծառայություն մատուցելու զինված ուժերում: Ինձ 2013թ. դատում են ծառայության չներկայանալու համար, բայց ես չեմ հանդիսացել այն սուբյեկտը, որի նկատմամբ կարելի է կիրառել քրեական օրենսգրքի տվյալ հոդվածը: Այսինքն` տեղի է ունեցել օրենքի սխալ կիրառելիություն, որի վերաբերյալ կան բոլոր փաստերը, Վճռաբեկ դատարանի համապատասխան  որոշումը: Համաձայն քրեական դատավարության օրենսգրքի, ես պարտավոր չեմ ապացուցելու իմ անմեղությունը կամ մեղավորությունը, դա դատախազության վրա է դրված, որը դատախազությունը չի կատարել: Ապօրինի կերպով առաջադրել է մեղադրանք, կատարել է քրեորեն պատժելի արարք, այժմ ես պահանջում եմ պատժել մեղավորներին, որոնց պատճառով ես հայտնվել եմ ճաղերի հետեւում»,-ասաց նա:

Ցոլակ Խաչատրյանը նշեց, որ Հայաստանի դատական ներպետական ատյանները սպառելուց հետո դիմելու է Մարդու իրավունքների Եվրոպական դատարան, որտեղ վստահ է, որ կշահի. « Եթե մեր իրավապահների կողմից այս հարցը չլուծվի, ապա ՄԻԵԴ-ում  մեր հայկական վարիանտը չի գործելու: Եթե կա պայմանագիր թող պատժեն, բայց չի եղել պայմանագիր, ես այդպիսի արարք չեմ կատարել, ծառայությունից ապօրինի կերպով չեմ բացակայել, բայց հայտնվել եմ ճաղերի հետեւում»:

Նշենք, որ Ցոլակ Խաչատրյանը հանդիպում է պահանջում ՀՀ գլխավոր դատախազի եւ ՀՀ մարդու իրավունքների պաշտպան հետ: Նա պահանջում է պատժել նրանց, որոնց սխալի պատճառով, իր պնդմամբ` հայտնվել է անազատության մեջ:
