Հայաստանում կամավորական գործունեության համար սահմանվում են խաղի նոր կանոններ

 ՀՀ աշխատանքի և սոցիալական հարցերի նախարարության կողմից ներկայացված նոր հայեցակարգով կամավորական գործունեության համար սահմանվում են խաղի նոր կանոններ:

Արմենպրեսի մամուլի սրահում հրավիրված ասուլիսում ՀՀ աշխատանքի և սոցիալական հարցերի նախարարի  աշխատանքի և զբաղվածության հարցերով  գլխավոր  խորհրդական Թադևոս Ավետիսյանը նշեց, որ կամավորական գործունեության և կամավոր աշխատանքի ոլորտում դեռևս առկա են օրենքով կարգավորման ենթակա խնդիրներ, որոնք կարող են խոչընդոտել ոլորտի կայացմանն ու հետագա զարգացմանը:

Նախարարության կողմից ներկայացված հայեցակարգով նախ պայմաններ են ստեղծվում կամավոր և անօրինական աշխատանքի հստակ տարանջատման համար: Օրենքով պետք է ամրագրվի, որ կամավոր գործունեության հիմքում պետք է լինի կամավորական աշխատանքի մասին պայմանագիրը: Այսինքն` կլինեն պայմանագրային հարաբերություններ, որոնք ներկայում չկան, եթե կան էլ, ապա կարգավորված չեն:

«Հաջորդ փոփոխությունն այն է, որ կամավորական կազմակերպությունները պետք է տեղեկատվական մատյաններ վարեն կամավորների վերաբերյալ: Լիազոր մարմինը, որը կառավարության որոշմամբ կլինի Աշխատանքի և սոցիալական հարցերի նախարարությունը, արդեն պարտավորվելու է վարել տեղեկատվական ամբողջական շտեմարան, որտեղ կլինեն բոլոր կազմակերպություններից ստացված տեղեկությունները կամավորների մասին»,- ասաց Թադևոս Ավետիսյանը: Հայեցակարգով առաջարկվում է հստակ սահմանել այն ոլորտները, որտեղ հնարավոր է իրականացնել կամավորական գործունեություն: Մաս նավորապես, սոցիալական պաշտպանություն, առողջապահություն, կրթություն, մշակույթ, շրջակա միջավայրի պաշտպանություն և այլն:

«Պետք է սահմանվեն որոշակի խաղի կանոններ կամավորի և կազմակերպության միջև: Մասնավորապես, այսօր կարգավորված չէ, թե կամավորի կյանքին կամ առողջությանը վնաս պատճառվելու դեպքում ով պետք է փոխհատուցի: Այստեղ պետք է լուծումներ գտնվեն: Դժբախտ պատահարների դեպքում մարդը պետք է ստանա փոխհատուցում: Չէ՞ որ նա թեկուզ կամավոր, բայց կատարում է աշխատանք»,-ասաց Թադևոս Ավետիսյանը:  

Նրա խոսքով՝ կամավորական կազմակերպությունը պետք է պարտավորվի հոգալ կամավորի նվազագույն ծախսերը, այն է՝ գործուղման գումար, օրապահիկ, գիշերակացի վճար և այլն: Օրենքով նման վճարները սահմանվելու դեպքում դրանք արդեն չեն դիտվի որպես աշխատավարձ: Կամավորական կազմակերպությունը դա հանգիստ կձևակերպի, և դա հարկման ենթակա չի լինի:

Արդյոք օրենսդրությամբ սահմանվելո՞ւ է վերահսկող մարմին, որպեսզի օրենքով սահմանված դրույթները պատշաճ կարգով կյանքի կոչվեն կազմակերպությունների կողմից: Հարցին ի պատասխան՝ Թադևոս Ավետիսյանը նշեց, որ այդ հարցը քննարկումների փուլում է, սակայն հայեցակարգով նախատեսվել է մշտադիտարկում: Այսինքն` ոչ թե գտնել, պատժել, այլ վեր հանել խնդիրները և լուծումներ գտնել:
