 Ավտոտրանսպորտային միջոցը համայնքային վճարովի ավտոկայանատեղում կայանելու համար տեղական տուրքը կամ, այսպես կոչված, կարմիր գծերի համար չվճարելը, գործող իրավակարգավորմամբ, առաջացնում է ֆիքսված տուգանքի նշանակում՝ 5 հազար դրամ: ՀՀ արդարադատության նախարար Արփինե Հովհաննիսյանը, ներկայացնելով Վարչական իրավախախտումների վերաբերյալ ՀՀ նոր օրենսգրք ի և հարակից օրենքների նախագծերի փաթեթը, առաջարկել է սահմանել, որ տուգանքը կարող է կազմել  3 հազարից 5 հազար դրամ: Այս մասին տեղեկացրին ՀՀ արդարադատության նախարարության տեղեկատվության և հասարակայնության հետ կապերի վարչությունից:

Նախարարի խոսքով՝ նոր օրենսգրքի մշակման աշխատանքներին մասնակցել են ինչպես տեղական, այնպես էլ միջազգային փորձագետներ. նախագիծն արժանացել վերջինների բարձր գնահատականին:

«Ընդունված լինելով դեռևս 1985 թվականին՝ Վարչական իրավախախտումների վերաբերյալ օրենսգիրքը ամենաշատն է ենթարկվել փոփոխությունների ու լրացումների, իսկ ոլորտը կանոնակարգող օրենսդրական ակտերում պարբերաբար կատարվել են տարաբնույթ, երբեմն էլ իրարամերժ ու հակասական փոփոխություններ»,- նշեց նախարարը՝ ընդգծելով, որ այս նախագծով վերանայվել են ինչպես իրավախախտումների համար նախատեսված վարչական տույժի տեսակները և դրանց չափերը, այնպես էլ նախատեսվել են կանոնակարգումներ, որոնք, ի տարբերություն գործող օրենսգրքի, հնարավորություն են տալու պատասխանատվություն սահմանելիս, իսկապես, հաշվի առնել անձի գույքային դրությունը, իրավախախտման մեղմացնող հանգամանքները: Մասնավորապես, մի շարք իրավախախտումների դեպքում, ելնելով հանրային վտանգավորության աստիճանից, գործող բացարձակ որոշակի տուգանքի փոխարեն նախատեսվել է նախազգուշացում և հարաբերական որոշակի սանկցիա, իսկ որոշ իրավախախտումների դեպքում տուգանքի չափը նվազեցվել է: «Այսինքն՝ ֆիքսված տուգանքի չափը, որը վարչական մարմինը կիրառում էր իրավախախտման բոլոր դեպքերում՝ անկախ իրավախախտման փաստական հանգամանքներից, մեղմացնող կամ ծանրաց նող հանգամանքներից, փոխարինվել է՝ սահմանելով տուգանքի նվազագույն և առավելագույն չափեր, ինչը հնարավորություն կտա յուրաքանչյուր դեպքում հաշվի առնել կոնկրետ իրավախախտման փաստական հանգամանքները»,- ասաց Արփինե Հովհաննիսյանը:
