ԿԸՀ-ն «Իրավունքի Եվրոպա միավորում» ՀԿ-ի ընտրախախտումների վերաբերյալ դիմում-բողոքը մերժեց

«Իրավունքի Եվրոպա միավորում» հասարակական կազմակերպության և նշված կազմակերպության մի շարք դիտորդների  դիմում-բողոքով ներկայացված վարչական վարույթի հարուցումը Կենտրոնական ընտրական հանձնաժողովը մերժեց: Կենտրոնական ընտրական հանձնաժողովի արտահերթ նիստի ժամանակ Կենտրոնական ընտրական հանձնաժողովի նախագահ Տիգրան Մուկուչյանը նշեց, որ տ վյալ դիմումում չի ներկայացվել, թե ինչ օրենք է խախտվել և չի դրված հստակ պահանջ:

Դիմումում ներկայացվել են 2017 թվականի մայիսի 14-ի Երևանի ավագանու ընտրությունների ժամանակ հասարակական կազմակերպության դիտորդների կողմից ընտրատեղամասերում արձանագրված մի շարք խախտումները:  

«Ընտրական օրենսգրքի պահանջների համաձայն՝ ցանկացած դիմում պետք է պարունակի իրավական հիմնավորումներ, պետք է հստակ ձևակերպված պահանջ: Այս դիմումում չի պարունակում ոչ իրավական հիմնավորում, ոչ պահանջի հստակեցում»,- ընդգծեց Մուկուչյանը:

Ներկայացնելով Կենտրոնական ընտրական հանձնաժողովի սույն դիմումի վերաբերյալ որոշման նախագիծը՝ Մուկուչյանը, մասնավորապես, նշեց.

«Դիմումատուներն իրենց սուբյեկտիվ իրավունքների խախտման որևէ փաստ դիմում-բողոքում չեն վկայակոչում, բարձրաձայնում են ընտրատեղամասերում քվեարկության կանոնակարգի ենթադրյալ խախտումների մասին, որոնք չեն առնչվում որպես դիտորդների պատկանող իրավունքների հետ, ուստի ԿԸՀ-ն գտնում է, որ դիմումատուները չեն հանդիսանում դիմում-բողոք վկայակոչվող իրավունքների պաշտպանությամբ դիմելու իրավունք ունեցող իրավասու սուբյեկտներ»,- նշեց Մուկուչյանը:

Կենտրոնական ընտրական հանձնաժողովը վերոհիշյալ որոշման նախագիծը ընդունեց միաձայն:
