ՀՀ արդարադատության նախարարի տեղակալ Սուրեն Քրմոյանը մայիսի 24-ին ՀՀ պրոբացիայի պետական ծառայությունում մասնակցել է պրոբացիոն ծառայության աշխատակիցների վերապատրաստմանը:

Ինչպես տեղեկացրին ՀՀ արդարադատության նախարարության տեղեկատվության և հասարակայնության հետ կապերի վարչությունից,

դասընթացն անցկացնում է Իսրայելից ժամանած փորձագետ Այվարես Դալդերիսը՝ ԵԽ «Էլեկտրոնային մոնիթորինգի սարքավորումների փորձարկում քրեակատարողական հիմնարկների պիլոտային ստորաբաժանումներում» դրամաշնորհային ծրագրի շրջանակում:

Սուրեն Քրմոյանի խոսքով՝ պիլոտային ծրագիրը դեռևս պետք է անցնի իր փորձությունը՝ հնարավորություն տալով գնահատել դրա արդյունավետությունը և հետևաբար հետագայում դրա լիարժեք կիրառելիության նպատակահարմարությունը: 

«Այդ հարցերին հնարավոր կլինի անդրադառնալ ծրագրի ավարտից և արդյունքների ամփոփումից հետո՝ 2017 թվականի սեպտեմբերին»,- ասել է նախարարի տեղակալը:

ՀՀ ԱՆ դատաիրավական ԾԻԳ տնօրեն Տաթևիկ Դավթյանը տեղեկացրել է, որ երկօրյա վերապատրաստման ընթացքում պրոբացիայի 10 աշխատակիցներ կծանոթանան դատապարտյալների վերահսկման էլեկտրոնային սարքավորումների օգտագործման և կիրառման կանոններին, այդ ընթացքում ծագող տեխնիկական խնդիրներին ու դրանց հնարավոր լուծումներին:

 Նա ընդգծել է նաև, որ հետագայում վերապատրաստված աշխատակիցները, ըստ անհրաժեշտության, նշված սարքավորումների կիրառման կանոնները կուսուցանեն պրոբացիայի ծառայության անձնակազմի մյուս աշխատակիցներին:

«Էլեկտրոնային հսկողության կիրառման համար օգտագործվող սարքավորումներն ամրացվում ենպրոբացիայի շահառուին կամ տեղադրվում են վերջինիս բնակության կամ գտնվելու վայրում, որնէլ իրականացվում է Գլոբալ տեղորոշման համակարգով (GPS) աշխատող կամ ռադիոալիքային, կենսաչափական, արբանյակային կամ այլ տեխնիկական սարքերի և էլեկտրոնային ծրագրերիկիրառմամբ, որոնք հնարավորություն են տալիս պարզելու պրոբացիայի շահառուի գտնվելուվայրը, տեղաշարժը, վարքագիծը և դատական ակտով սահմանված սահմանափակումներիպահպանումը»,- նշել է Տաթևիկ Դավթյանը:

Նշենք, որ ՀՀ օրենսդրության համաձայն՝ Էլեկտրոնային հսկողությունը կիրառվում է քրեական վարույթի մինչդատական և դատական քննության փուլերում՝ որպես այլընտրանքային խափանման միջոցների և անվտանգության միջոցների հետ համակցված միջամտություն կամ պատժի կատարման փուլում՝ որպես պատժի կատարման հետ համակցված հսկողության միջոց կամ հետպատժյա փուլում:

Պատժի կատարման, պատիժը պայմանականորեն չկիրառելու, պատժի կրումից ազատելու, պատժից պայմանական վաղաժամկետ ազատման դեպքում փորձաշրջանի մեջ գտնվող կամ պատժի կրումը հետաձգված անձանց նկատմամբ սահմանված վերահսկողության իրականացման ընթացքում էլեկտրոնային հսկողությունը կիրառվում է դատական ակտով` դատախազի, պաշտպանության կողմի միջնորդությամբ կամ դատարանի սեփական նախաձեռնությամբ, իսկ պատժի կատարման փուլում` պրոբացիայի ծառայության միջնորդությամբ:

Վերապատրաստմանը ներկա է եղել նաև ՀՀ ԱՆ Պրոբացիայի պետական ծառայության պետ Արսեն Նավասարդյանը:
