Հայաստանի Հանրապետության արդարադատության նախարարի տեղակալ Սուրեն Քրմոյանը մայիսի 26-ին մասնակցել է Անչափահասների արդարադատության խորհրդի հերթական նիստին: Այն կազմակերպել էր ՀՀ արդարադատության նախարարությունը՝ Հայաստանում ՄԱԿ-ի մանկական հինադրամի աջակցությամբ:

Սուրեն Քրմոյանը բարձր է գնահատել անչափահասների իրավունքների պաշտպանության ոլորտում ՀՀ արդարադատության նախարարության սերտ համագործակցությունը ՄԱԿ-ի մանկական հիմադրամի հետ և նշել, որ Խորհուրդը ստեղծել է մի հարթակ, որի գլխավոր նպատակն է համատեղ ջանքերի օգնությամբ անչափահասների արդարադատությունը դարձնել առավել արդյունավետ: Այս մասին տեղեկացրին ՀՀ արդարադատության նախարարության տեղեկատվության և հասարակայնության հետ կապերի վարչությունից:

Նիստի ընթացքում ՀՀ արդարադատության ակադեմիայի դասախոս Տ. Պողոսյանը խորհրդի անդամներին ներկայացրել է «Անչափահասների պաշտպանությունը քրեական գործով վարույթի ընթացքում» հեռաուսուցման առցանց դասընթացը, որի շրջանակում մասնագիտական վերապատրաստում են անցնում անչափահասների արդարադատության հարցերով զբաղվող առանցքային դերակատարները՝ դատավորները, դատախազները, ինչպես նաև արդարադատության համակարգի այլ աշխատակիցները:

ՀՀ արդարադատության նախարարության ՔԿԱԳ գործակալության պետ Անի Մխրթարյանն անդրադարձել է «Հայաստանի Հանրապետություն անօրինական տեղափոխված կամ պահվող երեխայի վերադարձի վարույթի մասին» ՀՀ օրենքի նախագիծը և նշել, որ դրա հիմնական նպատակն է ապահովել «Երեխաների միջազգային առևանգման քաղաքացիական մոտեցումների մասին» Հաագայի 1980 թվականի կոնվենցիայով ստանձնած պարտավորությունների կատարումը:

Անի Մխիթարյանի խոսքով, Հայաստանը Կոնվենցիայի եզակի անդամ պետություններից է, որն առևանգման վարույթն իրականացնում է վարչական ընթացակարգով և ընդգծել է, որ հենց դա է հանդիսանալու նախագծի հիմնական սկզբունքային փոփոխությունը:

Ըստ Մխիթարյանի՝ անդամ երկրների մեծամասնությունը երեխայի վերադարձի կամ վերադարձի մերժման որոշումների կայացումը վերապահել է դատական մարմիններին, ինչը իրավական առումով իրավունքի սահմանափակման տեսանկյունից ավելի հիմնավորված է, քան վարչական մարմնի կողմից նույն սահմանափակման կիրառումը վարչական որոշման շրջանակներում:

Անչափահասների արդարադատության խորհրդի նիստի ընթացքում քննարկվել են նաև անչափահասների գործով քննիչների մասնագիտական վերապատրասմանը, անչափահասի ռիսկերի և կարիքների գնահատման միասնական մոտեցմանը վերաբերող հարցեր:

Նիստին մասնակցել են պետական գերատեսչությունների, միջազգային և հասարակական կառույցների ներկայացուցիչներ:
