Կառավարությունը կքննարկի զինվորական ծառայություն չանցած քաղաքացիների քրեական հետապնդումը դադարեցնելու նախագիծը

 ՀՀ կառավարությունը քննարկելու է «Սահմանված կարգի խախտմամբ պարտադիր զինվորական ծառայություն չանցած քաղաքացիների մասին» ՀՀ օրենքի գործողության ժամկետը մինչև 2017 թվականի մայիսի 1-ը երկարաձգելու նախագիծը, որը ներկայացրել է ՀՀ սփյուռքի նախարարությունը: Ինչպես փոխանցում է Արմենպրեսը, նախագիծն ընդգրկված է կառավարության հունիսի 1-ի նիստի օրակարգում:

Վերջին անգամ «Սահմանված կարգի խախտմամբ պարտադիր զինվորական ծառայություն չանցած քաղաքացիների մասին» ՀՀ օրենքի 1-ին հոդվածում փոփոխությունը կատարվել է 2015 թվականի ապրիլի 30-ի օրենքով, որի համաձայն օրենքի գործողության ոլորտն ընդգրկել է 1992 թվականի աշնանային զորակոչից մինչև 2015 թվականի մայիսի 1-ն ընկած ժամանակահատվածը:

Հարուցված քրեական հետապնդումը դադարեցնելու նպատակով համապատասխան ՀՀ օրենքում մինչ այժմ փոփոխություններ են կատարվել յոթ անգամ:

Ակնկալվում է, որ ժամկետի երկարաձգումը կնպաստի հազարից ավելի անձանց հայրենադարձությանը,հնարավորություն կտա նրանց սահմանված ժամկետում մուծել համապատասխան վճարը, ազատվելքրեական հետապնդումից: Սահմանված կարգով վճարները կմուտքագրվեն ՀՀ պաշտպանությաննախարարության հատուկ այդ նպատակով բացված հաշվեհամարին:

Ըստ նախագծի հիմնավորման, «Զինապարտության մասին» ՀՀ օրենքով սահմանված կարգի խախտմամբ պարտադիր զինվորական ծառայության զորակոչից նախկին տարիների ընթացքում խուսափած ու 27 տարին լրացած բազմաթիվ ՀՀ քաղաքացիներ խուսափելով քրեական հետապնդումից գտնվում ենՀայաստանի սահմաններից դուրս: Հարուցված քրեական գործերով հետախուզման մեջ գտնվելու պատճառով ներկայումս հազարավոր անձինք հնարավորություն չունեն վերադառնալու Հայաստան: Այդ կապակցությամբ հիշյալ անձանցից և նրանց հարազատներից ստացվում են բազմաթիվ հեռախոսազանգերու դիմումներ:
