ՀՔԾ-ում կտրուկ աճել է սուտ մատնությունների վերաբերյալ քննվող քրեական գործերի քանակը

 ՀՀ հատուկ քննչական ծառայությունը չնայած բազմիցս բարձրաձայնել է, որ նախաքննական մարմնին հանցագործության մասին գիտակցաբար սուտ տեղեկություններ հաղորդելը քրեորեն պատժելի արարք է, այդուհանդերձ, շատ քաղաքացիներ շարունակում են իրականությանը չհամապատասխանող հաղորդումներ ներկայացնել` անտեսելով դրա համար նախատեսված քրեական պատասխանատվության հանգամանքը: Ընդ որում, սուտ մատնությունների աճի միտումը Հատուկ քննչական ծառայությունում պահպանվում է 2015 թվականից առ այսօր. այսպես, եթե 2015թ.-ի ամբողջ տարվա ընթացքում քննվել է ՀՀ քրեական օրենսգրքի 333-րդ հոդվածի տարբեր մասերի հատկանիշներով հարուցված 21 քրեական գործ, ապա 2016թ.-ին դրանց թիվն ավելի քան կրկնակի աճել է՝  հասնելով 44-ի: Սուտ մատնության փաստերով քննված քրեական գործերի կտրուկ աճ է արձանագրվել նաև այս տարի. 2017 թվականի հունիսի 12-ի դրությամբ այս բնույթի քրեական գործերի քանակն արդեն հասել է 36-ի` նախորդ տարվա նույն ժամանակահատվածում քննված 26-ի փոխարեն: Այս մասին տեղեկացրին ՀՔԾ լրատվական ծառայությունից:

Հարկ է նշել, որ սուտ մատնությունների դեպքերի վերաբերյալ քրեական գործերի աճին էականորեն նպաստել են որոշ քաղաքացիների կողմից իրավունքի չարաշահման դեպքերը, երբ տարբեր հանցագործություններ կատարած անձինք իրենց առաջադրված մեղադրանքից պաշտպանվելու, նախաքննության ընթացքում տված խոստովանական ցուցմունքներն անթույլատրելի դարձնելու, հաճախ նաև իրավապահ մարմնի այս կամ այն աշխատակցից վրեժ լուծելու նպատակով, իրականությանը չհամապատասխանող բազմաթիվ դիմում-հաղորդումներ են ներկայացնում Հատուկ քննչական ծառայություն կամ հենց դատաքննության ժամանակ հայտարարություններ անում իրենց նկատմամբ ֆիզիկական կամ հոգեբանական բռնություն կիրառելու մասին:

Առանձնահատուկ պետք է ընդգծել, որ սուտ մատնությունների փաստով հարուցված բոլոր քրեական գործերը, որպես կանոն, ավարտվում են մեղադրական եզրակացությամբ և ուղարկվում դատարան` մեղավոր անձանց քրեական պատասխանատվության ենթարկելու նպատակով: Ընդ որում, քիչ չեն դեպքերը, երբ այս արարքում մեղադրվող անձինք դատապարտվում են ազատազրկման:

Հաշվի առնելով վերոգրյալը` Հատուկ քննչական ծառայությունը  հարկ է համարում կրկին տեղեկացնել, որ հանցագործության մասին սուտ մատնություն կատարելը քրեորեն պատժելի արարք է և կոչ է անում մեր քաղաքացիներին` զերծ մնալ իրավապահ մարմիններին ակնհայտ սուտ տեղեկություններ ներկայացնելու արատավոր պրակտիկայից:

Ծանուցում. ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
