ՊՊԾ գնդի գործով ամբաստանյալ Վարուժան Ավետիսյանը հեռացվեց նիստերի դահլիճից. պաշտպանի նկատմամբ կիրառվեց սանկցիա

Երևան քաղաքի Ավան և Նոր Նորք վարչական շրջանների ընդհանուր իրավասության առաջին ատյանի դատարանում դատավոր Արտյուշ Գաբրիելյանի  նախագահությամբ հերթական մեկժամյա ընդմիջումից հետո մեկնարկեց  

Մինչ այդ, դատավոր Արտյուշ Գաբրիելյանը 6 ժամով հեռացրեց ամբաստանյալ Գագիկ Եղիազարյանին դատարանի նիստերի դահլիճից` տեղից խոսելու և դատավորի հանդեպ անհարգալից վերաբերմունքի  համար:

Գագիկ Եղիազարյանի պաշտպան Տիգրան Եգորյանը գրավոր դիմում էր ներկայացրել դատավորին՝ նշելով, որ իր պաշտպանյալ Գագիկ Եղիազարյանի՝ դատարանի դահլիճից 6 ժամով հեռացվելու կապակցությամբ նա չի մասնակցելու հունիսի 21-ի նիստին և խնդրում է պարզաբանել իր պաշտպանյալի նկատմամբ կիրառված սանկցիայի տևողության հարցը:

Սույն դիմումի վերաբերյալ դատարանը որոշեց սանկցիա կիրառել Տիգրան Եգորյանի նկատմամբ` դատարան չներկայանալու և իր մտադրության մասին միայնգրավոր տեղեկացնելու հիմնավորմամբ:

Պաշտպան Իննեսա Պետրոսյանը պնդեց, որ ոչ բոլոր պաշտպաններն են ծանուցվել դատական նիստի վայրի և ժամի տեղափոխման վերաբերյալ, մասնավորապես պաշտպան Հայկ Ալումյանը:

Դատավոր Արտյուշ Գաբրիելյանը այս կապակցությամբ նշեց, որ դեռևս դատական նիստը գտնվում է նախապատրաստական փուլում, որի ընթացքում ստուգվում են դատարանում գտնվող անձանց ինքնությունները և որևէ այլ գործողություն չի իրականացվում, որը կոտնահարի ամբաստանյալի իրավունքները` պաշտպան չունենալու հանգամանքով:

Ամբաստանյալներից Վարուժան Սուքիասյանը առանց դատարանի թույլտվության տեղից խոսեց, ինչի պատճառով դատավոր Արտյուշ Գաբրիելյանն ամբաստանյալին հեռացրեց դատական նիստերի դահլիճից և ևս մեկ անգամ ստիպված եղավ մեկժամյա ընդմիջում հայտարարել:

Նիստից հետո լրագրողների հետ հանդիպման ժամանակ Վարուժան Ավետիսյանի պաշտպան Մուշեղ Շուշանյանը հայտարարեց, որ չի մասնակցելու դատական նիստերին:

«Ես նման ցուցում ունեմ իմ պաշտպանյալից: Սույն գործով հանդիսանում եմ նաև Արեգ Կյուրեղյանի պաշտպան և նրանից նույնպես ունեմ համաձայնություն դատական նիստերին չմասնակցելու մասին»,- ընդգծեց Շուշանյանը:

Պաշտպանը նաև չի կարողանում հասկանալ դատարանի կողմից ամեն անգամ սանկցիայի կիրառումից հետո ընդմիջում հայտարարելու տրամաբանությունը:
