Քննիչների կողմից ցուցմունք տալուն հարկադրելու և կեղծիքներ կատարելու հաղորդումների հիման վրա հարուցվել է քրգործ

ՀՀ հատուկ քննչական ծառայությունում քրեական գործեր են հարուցվել ՀՀ քննչական կոմիտեի տարբեր ստորաբաժանումների քննիչների կողմից ցուցմունք տալուն հարկադրելու, առանձնապես ծանր հանցագործության վերաբերյալ գործով ապացույց կեղծելու և պաշտոնեական կեղծիք կատարելու դեպքերի վերաբերյալ ՀՀ քաղաքացիներից ստացված հաղորդումների հիման վրա:

Ինչպես «Արմենպրես»-ին հայտնեցին ՀՀ Հատուկ քննչական ծառայությունից,  Արարատի և Վայոց ձորի մարզերի ընդհանուր իրավասության դատարանում քննվող քրեական գործով վկա Գ. Մանասերյանը դատարանում ցուցմունք, ապա` Հատուկ քննչական ծառայությունում հաղորդում է տվել, որ ՀՀ ՔԿ Վայոց ձորի մարզային քննչական վարչության քննիչը, հանդիսանալով իր բարեկամը, իրեն հարցաքննելիս պահանջել է ցուցմունքում նշել իրականությանը չհամապատասխանող տեղեկություններ` հայտնելով, որ հակառակ դեպքում խնդիրներ կունենա:

Բացի այդ, Գ. Մանասերյանը հաղորդմամբ հայտնել է, որ նույն քրեական գործով կատարված քննչական գործողության` առերեսման ժամանակ, ՀՀ քննչական կոմիտեի քննիչին հայտնել է իրականությունը, սակայն վերջինս այդ մասին կազմած արձանագրությունում ներառել է իր նախորդ ցուցմունքում նշած` իրականությանը չհամապատասխանող տեղեկություններ:

Նկատի ունենալով, որ հիշյալ դեպքի առթիվ նախապատրաստված նյութերում առկա են ՀՀ քննչական կոմիտեի պաշտոնատար անձանց կողմից ցուցմունք տալուն հարկադրելու և առանձնապես ծանր հանցագործության վերաբերյալ գործով ապացույց կեղծելու ենթադրյալ հանցագործության հատկանիշներ, ուստի ՀՀ հատուկ քննչական ծառայությունում քրեական գործ է հարուցվել ՀՀ քրեական օրենսգրքի 341-րդ հոդվածի 1-ին մասով և 349-րդ հոդվածի 3-րդ մասի 1-ին կետով:

Մյուս քրեական գործը հարուցվել է ՀՀ քաղաքացի Հ. Գրիգորյանի հաղորդման հիման վրա: Վերջինս հայտնել է, որ իր որդու վերաբերյալ ՀՀ ՔԿ Կենտրոն և Նորք-Մարաշ վարչական շրջանների քննչական բաժնում խարդախության հատկանիշներով քննվող քրեական գործի շրջանակներում նույն բաժնի քննիչի առաջարկով կատարվել են որդու կողմից գրավադրված ձուլակտորների մասնատման և ոսկու զտման գործողություններ: Ըստ Հ. Գրիգորյանի` նշված գործողությունների ժամանակ քննիչը որևէ  արձանագրություն չի կազմել, սակայն ինքը հետագայում պարզել է, որ վերջինս կեղծ արձանագրություն է կազմել, որում իրականությանը չհամապատասխանող տվյալներ է նշել գործողություններին չմասնակցած անձանց, այդ թվում`որդու վերաբերյալ:

ՀՀ քննչական կոմիտեի քննիչի կողմից պաշտոնեական կեղծիք կատարելու դեպքի առթիվ ՀՀ հատուկ քննչական ծառայությունում քրեական գործ է հարուցվել ՀՀ քրեական օրենսգրքի 314-րդ հոդվածի 1-ին մասով:

Երկու քրեական գործերով նախաքննությունը շարունակվում է: 

Ծանուցում. ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
