ՀՀ կառավարության 2010թ. դեկտեմբերի 30-ի որոշմամբ հաստատված կարգով սահմանվել է 2011թ.-ից անշարժ գույքի և դրա նկատմամբ գրանցված իրավունքների հետ կապված գործարքների վերաբերյալ տեղեկությունները ՀՀ ԿԱ անշարժ գույքի կադաստրի պետական կոմիտեի կողմից առցանց ռեժիմով, ՎԵԲ ծառայության միջոցով, յուրաքանչյուր եռամսյակ ՀՀ ԿԱ պետական եկամուտների կոմիտե ներկայացնելու պարտադիր պահանջ: Այս մասին  տեղեկացրին ՀՀ դատախազության հանրային կապերի բաժնից:

ՀՀ գլխավոր դատախազության պետական շահերի պաշտպանության վարչության կողմից նշված գործընթացի ուսումնասիրությամբ պարզվել է, որ ՀՀ ԿԱ անշարժ գույքի կադաստրի պետական կոմիտեում ներդրված ARPIS էլեկտրոնային համակարգում չեն վերծանվել 2013-2017 թվականների հաշվետու եռամսյակների վերջին օրերի գործարքները (համակարգը վերծանել է մինչև եռամսյակի վերջին օրվա գործարքները): Արդյունքում հանրապետության տարածքում կատարված անշարժ գույքի 3204 գործարքների վերաբերյալ տեղեկությունները չեն արտացոլվել եռամսյակային հաշվետվություններում և չեն ներկայացվել ՀՀ ԿԱ պետական եկամուտների կոմիտեին: 

Մասնավորապես՝ նշված էլեկտրոնային համակարգում չեն վերծանվել տնտեսվարող սուբյեկտների կողմից կատարված՝ ԱԱՀ-ով հարկման ենթակա ընդհանուր 1.108.058.395 դրամ կադաստրային և 3.258.931.861 դրամ պայմանագրային արժեքով թվով 110 գործարքների և ֆիզիկական անձանց կողմից կատարված՝ 76 հասարակական, արտադրական նշանակության՝ ընդհանուր 1.092.450.019 դրամ կադաստրային և 1.073.993.510 դրամ պայմանագրային արժեքով անշարժ գույքի նկատմամբ գործարքները, ինչի հետևանքով պետական լիազոր մարմինը տարիներ շարունակ զրկվել է հարկերի գանձման գործառույթներն օրենքով սահմանված կարգով պատշաճ իրականացնելու հնարավորությունից: 

Ստացված տվյալները տրամադրվել են ՀՀ ԿԱ պետական եկամուտների կոմիտեին և հանձնարարվել է պարզել հարկման ենթակա այն գործարքները, որոնցով չեն հաշվարկվել և չեն գանձվել հարկման ենթակա գումարները: 

Ուսումնասիրության ներկա փուլում արդեն իսկ ստացված փաստական տվյալների համաձայն՝ ֆիզիկական անձանց կողմից կատարված հասարակական, արտադրական նշանակության անշարժ գույքի նկատմամբ 58.350.000 դրամը գերազանցող 5 գործարքներ (որոնցից 2-ը կատարվել են 30.06.2014թ., մյուսները՝ 31.03.2014թ., 30.09.2014թ., 31.03.2016թ.)` ընդհանուր 682.699.420 դրամ արժեքով, չեն հայտարարագրվել, և պետական բյուջե չի վճարվել ընդհանուր շուրջ 78.189.884 դրամ ԱԱՀ-ի գումար՝ առանց տույժ տուգանքի: 

Իսկ տնտեսվարող սուբյեկտների կողմից կատարված` ընդհանուր 7.859.000 դրամ արժեքով 3 գործարքներով հաշվարկներ չներկայացվելու հետևանքով պետական բյուջե չի վճարվել ընդհանուր շուրջ 1.571.800 դրամ ԱԱՀ գումար՝ առանց տույժ տուգանքի (այդ տնտեսվարող սուբյեկտների գործունեությունը դադարեցված է): 

ՀՀ ՊԵԿ-ի կողմից ստուգումները շարունակվում են: Սակայն,  նկատի ունենալով, որ  արդեն իսկ հայտնաբերված խախտումներն առերևույթ պարունակում են հանցագործության հատկանիշներ՝ պաշտոնատար անձանց կողմից ծառայության նկատմամբ անփույթ կամ անբարեխիղճ վերաբերմունքի հետևանքով պետության օրինական շահերին առանձնապես խոշոր չափերով վնաս  է պատճառվել, ՀՀ գլխավոր դատախազության պետական շահերի պաշտպանության վարչությունում ՀՀ քրեական օրենսգրքի 315-րդ հոդվածի 2-րդ մասով հարուցվել է քրեական գործ: 

Նախաքննության կատարումը հանձնարարվել է ՀՀ քննչական կոմիտեին:
