ԱԺ-ն ամբողջությամբ ընդունեց ընտանիքում բռնության դեմ պայքարի և դրա կանխարգելման մասին օրինագիծը

Հայաստանի Ազգային ժողովը երկրորդ ընթերցմամբ ընդունեց ընտանիքում բռնության դեմ պայքարի և դրա կանխարգելման մասին օրինագիծը:

Ինչպես հաղորդում է «Արմենպրես»-ը, «Ընտանիքում բռնության կանխարգելման, ընտանիքում բռնության ենթարկված անձանց պաշտպանության և ընտանիքում համերաշխության վերականգման մասին» օրենքի նախագծին և հարակից նախագծերի փաթեթին կողմ քվեարկեց 75, դեմ՝ 12, ձեռնպահ՝ 8 պատգամավոր:

Օրենսդրական նախաձեռնության նպատակներն են ընտանիքում բռնության կանխարգելումը, այդ բռնության պատճառով տուժած անձանց իրավունքների պաշտպանությունը, ընտանիքում համերաշխության վերականգնումը: Օրենքը նախատեսում է ընտանիքում բռնությունների կանխարգելում և այդ նպատակին հասնելու համար առաջարկում կոնկրետ մեխանիզմներ: Օրենքը ենթադրում է պաշտպանական կամ կանխարգելիչ միջոցներ, որոնք երեքն են` նախազգուշացում, անհետաձգելի միջամտություն,  պաշտպանական որոշում:

Նախազգուշացման պարագայում կանխարգելիչ նշանակությունն առավել ցայտուն է երևում, քանի որ այստեղ գործը սահմանափակվում է միայն նրանով, որ ոստիկանության ներկայացուցիչը զգուշացնում է համապատասխան սուբյեկտին իր վարքագծի ոչ ճիշտ լինելու և դա շարունակելու պարագայում հնարավոր հետևանքների վերաբերյալ: Այն դեպքերում, երբ առկա է ընտանիքում բռնության դրսևորում և դրա շարունակման հնարավորություն, որը կարող է սպառնալ բռնության զոհերի կյանքին կամ առողջությանը, ոստիկանության ներկայացուցիչը կարող է որոշում կայացնել անհետաձգելի միջամտության վերաբերյալ: Այս միջոցը կարելի է կիրառել միայն ծայրահեղ դեպքերում, երբ անհրաժեշտ է առանց հետաձգման համապատասխան որոշում կայացնել մարդկանց կյանքը և առողջությունը պահպանելու համար: Օրենքը նաև նախատեսում է, որ նման որոշում կայացնում է ոչ թե ոստիկանության ցանկացած ներկայացուցիչ, այլ ոստիկանության մասնագիտացված հատուկ ծառայության աշխատակիցը, ով պետք է օժտված լինի համապատասխան գիտելիքներով, հմտություններով և փորձառությամբ: Երրորդ միջոցը, որ կարող է կիրառվել, պաշտպանական որոշումն է: Այս որոշումն ընդունում է միայն դատարանը` բացառապես տուժողի դիմումի հիման վրա:

Օրենքով նախատեսված է ապաստարանների ձևավորում, որոնք ընդամենը վայր են, որտեղ կարող են ժամանակավորապես տեղավորվել ընտանիքում բռնությունից տուժածները` մինչև ընտանիքի համար բարդ իրավիճակը կարգավորվելը:
