ՀՀ դատախազությունը բացահայտել է 8 տնտեսվարող սուբյեկտի կողմից շուրջ 2 մլրդ դրամի չափով հարկային պարտավորության չկատարելու փաստեր

ՀՀ գլխավոր դատախազության պետական շահերի պաշտպանության վարչության կողմից ուսումնասիրվել է ՀՀ կառավարության որոշումներով 2012 թվականի հունվարի 1-ից մինչև 2016 թվականի դեկտեմբերի 31-ն ընկած ժամանակահատվածում «Ավելացված արժեքի հարկի մասին» ՀՀ օրենքի 6.1-ին հոդվածի 1-ին մասով ներդրումային ծրագրերի շրջանակներում ԱԱՀ-ի գումարների վճարումը երեք տարի ժամկետով հետաձգելու արտոնություն ստացած տնտեսվարող սուբյեկտների կողմից ժամկետի ավարտից հետո ԱԱՀ վճարման  գործընթացում պետական շահերի պաշտպանության վիճակը: 

Նշված ժամանակահատվածում ԱԱՀ վճարման գծով ՀՀ կառավարության թվով 48 որոշումներով տնտեսվարող սուբյեկտները ստացել են արտոնություն ընդհանուր շուրջ 27 մլրդ ՀՀ դրամի չափով: Նրանցից 19-ի մասով ուսումնասիրության պահին լրացած է եղել արտոնության ժամկետը: 

Ինչպես տեղեկացրին ՀՀ դատախազության հանրային կապերի բաժնից, ՀՀ ԿԱ պետական եկամուտների կոմիտեից նշված 19 տնտեսվարող սուբյեկտների վերաբերյալ ստացված տեղեկատվությունից պարզ է դարձել, որ առկա է շուրջ 1,966 միլիարդ դրամի ԱԱՀ գծով չկատարված պարտավորություն՝ թվով 8 տնտեսվարող սուբյեկտների կողմից: 

Նշված 8 տնտեսվարող սուբյեկտներից 3-ը ճանաչվել են սնանկ (պարտավորության չափը շուրջ 893,2 միլիոն դրամ): Դրանցից 1 դեպքում սնանկության գործընթացում վաճառված գույքից միջոցներն անցել են ապահովված պարտատերերին, և ներկա դրությամբ ԱԱՀ պարտավորությունը մարելու համար տնտեսվարող սուբյեկտը գույք չունի (պարտավորության չափը 148 միլիոն դրամ): 3-ի դեպքում ԴԱՀԿ ծառայությունում հարուցվել են կատարողական վարույթներ (պարտավորության չափը շուրջ 237,9 միլիոն դրամ): Իսկ 2 տնտեսվարող սուբյեկտի դեպքում ԱԱՀ գծով պարտավորության գանձման ուղղությամբ միջոցներ չեն ձեռնարկվել հետագա օրենսդրական փոփոխություններով պայմանավորված: Արդյունքում ԱԱՀ վճարման գծով նշված 834,9 միլիոն դրամի չափով պարտավորությունն օրենքի ուժով վերացվել է: 

Բացի այդ, արտոնության տրամադրման գործընթացում առաջ են եկել մի շարք խնդրահարույց հարցեր: Մասնավորապես, առկա են դեպքեր, երբ կազմակերպությունները ներկրել են արտոնության տրամադրմանը վերաբերող՝ ՀՀ կառավարության որոշումներով սահմանված խմբաքանակներից ավել ապրանքներ, կամ օրենսդրական փոփոխությունների արդյունքում տնտեսվարող սուբյեկտների մի մասն ազատվել է միևնույն ապրանքախմբին դասվող ապրանքները ներմուծելու դեպքում առաջացող ԱԱՀ-ից, իսկ մյուս մասը՝ ոչ: 

Վերը նշված խնդիրների պարզաբանման, ինչպես նաև կազմակերպությունների կողմից ԱԱՀ վճարման գծով պարտավորությունների չկատարման հանգամանքները հստակեցնելու նպատակով համապատասխան հարցումներ են կատարվել ՀՀ ԿԱ պետական եկամուտների կոմիտեին:
