Պետությանն ավելի քան 168 մլն դրամի վնաս է պատճառվել. հարուցվել է թվով 5-րդ քրեական գործը

ՀՀ վերահսկիչ պալատի խորհրդի 2018թ. մարտի 19-ին հաստատված հաշվետվության եւ կից նյութերի ու փաստաթղթերի ուսումնասիրությամբ պարզվել է, որ 2016-2017թթ. ընթացքում ավտոմեքենաների սեփականատեր հանդիսացող անձինք, հանդիսանալով տեսանկարահանման եւ լուսանկարահանման միջոցով ամրագրված ՃԵԿ խախտումների սուբյեկտ, ապացույցներ են ներկայացրել գույք կամ եկամուտներ չունեցող 15 ֆիզիկական անձանց կողմից խախտումները կատարելու վերաբերյալ: Արդյունքում ՀՀ ոստիկանության ՃՈ ծառայության աշխատակիցները 14890 խախտումների համար նշանակված տուգանքների ընդհանուր 168090000 ՀՀ դրամ գումարն արձա-նագրել են գույք կամ եկամուտներ չունեցող այդ ֆիզիկական անձանց անվամբ:  Իսկ ՀՀ արդարադատության նախարարության ԴԱՀԿ ծառայության աշխատակիցներն ավարտել են վարչական ակտերով գումարների բռնագանձման վերաբերյալ կատարողական վարույթները՝ պարտապանի կողմից գույք կամ եկամուտներ չունենալու հիմքով:

Փաստացի ավտոմեքենաների սեփականատեր հանդիսացող անձինք խաբեության եղանակով խուսափել են վճարել վարչական տուգանքներ՝ առանձնապես խոշոր չափերի վնաս պատճառելով պետությանը, իսկ պետական ծառայություն իրականացնող պատասխանատու պաշտոնատար անձինք, շուրջ 2 տարի  շարունակ 15 ֆիզիկական անձի անվամբ ձեւակերպելով բազմաթիվ վարչական իրավախախտումներն ու կատարողական վարույթները, ծառայության նկատմամբ անբարեխիղճ կամ անփույթ վերաբերմունք դրսեւորելով, չեն կատարել կամ ոչ պատշաճ են կատարել իրենց պարտականությունները: Արդյունքում անզգուշությամբ էական վնաս է պատճառվել պետության օրինական շահերին՝ առաջացնելով ծանր հետեւանքներ:

Նկատի ունենալով, որ նշված գործողություններում առերեւույթ առկա են հանցագործության հատկանիշներ՝ ՀՀ գլխավոր դատախազության ավագ դատախազի որոշմամբ նշված փաստերով ՀՀ քրեական օրենսգրքի 184-րդ հոդվածի 2-րդ մասի 1-ին կետով եւ 315-րդ հոդվածի 2-րդ մասով նախատեսված հանցագործությունների հատկանիշներով: Քրեական գործի նախաքննությունը հանձնարարվել է  ՀՀ հատուկ քննչական ծառայությանը:

Նշենք, որ սա նման բնույթի թվով հինգերորդ քրեական գործի հարուցումն է:  Ինչպես արդեն տեղեկացվել է, ՀՀ գլխավորչ դատախազությունում մանրակրկիտ ուսումնասիրվում են ՀՀ վերահսկիչ պալատի խորհրդի կողմից ՀՀ արդարադատության նախարարության ԴԱՀԿ ծառայությունում իրականացված՝ 2016-2017թթ. ընթացքում պետական բյուջեից հատկացված միջոցների օգտագործման, բյուջետային մուտքերի ապահովման եւ սեփականության կառավարման նկատմամբ վերահսկողության արդյունքները: Ուսումնասիրությամբ ի հայտ բերված՝ առերեւութ հանցագործության հատկանիշներ պարունակող խախտումների փաստերով ՀՀ գլխավոր դատախազությունում հարուցվել էր 4 քրեական գործ, որոնց նախաքննությունը ՀՀ ՀՔԾ-ում շարունակվում է:

 

Արձանագրված մյուս խախտումները հիմնավորող լրացուցիչ փաստաթղթեր եւ նյութեր ներկայացնելու պահանջով ՀՀ ոստիկանություն եւ ՀՀ ԱՆ ԴԱՀԿ ծառայություն ուղարկված գրություններին ի պատասխան ստացված լրացուցիչ փաստաթղթերի եւ նյութերի ուսումնասիրության հիման վրա գնահատական կտրվեն արձանագրված մյուս խախտումներին, կկիրառվեն դատախազական ներգործության միջոցներ, մասնավորապես՝ պետական շահերի խախտման պատճառների եւ նպաստող պայմանների վերացման վերաբերյալ կներկայացվեն միջնորդագրեր: Կարող են հարուցվել նոր քրեական գործեր:
