ՀՀ զինվորական դատախազությունն ամփոփել է ԶՈՒ-ում պետական շահերի պաշտպանության ոլորտի առաջին եռամսյակի արդյունքները

ՀՀ զինվորական դատախազությունում ամփոփվել են 2018թ. 1-ին եռամսյակի ընթացքում զինված ուժերում պետական շահերի պաշտպանության ոլորտում ՀՀ զինվորական կենտրոնական դատախազության պետական շահերի պաշտպանության բաժնի և կայազորների զինվորական դատախազությունների դատախազների կողմից իրականացված աշխատանքները և դրանց արդյունքները։

Ինչպես տեղեկացրին ՀՀ դատախազության հանրային կապերի բաժնից,  պետական շահերի պաշտպանության հարցադրումներով իրականացվել է թվով 66 ուսումնասիրություն, որից 35-ը կատարվել է թիկունքային, 9-ը՝ սպառազինության, 8-ը՝ ֆինանսական, 5-ը՝ ռազմաբժշկական, 3-ը՝ կապի, 2-ը՝ ինժեներական, 2-ը՝ հրթիռահրետանային և 1-ական՝ կապիտալ շինարարության և այլ ծառայությունների գծով։

Այդ ուսումնասիրությունների արդյունքում արձանագրվել է 49  խախտում: Այսինքն` խախտումներ են հայտնաբերվել ուսումնասիրությունների շուրջ 75% դեպքերում։ Ելնելով արդյունքներից՝ ԶՈՒ համապատասխան կառույցներին և ստորաբաժանումներին տրվել է 8 նախազգուշացում, ուղարկվել է 14 հաղորդում։

2018 թվականի առաջին եռամսյակում իրականացված ուսումնասիրություններով արձանագրվել է պետությանը պատճառված 203.324.237 ՀՀ դրամի  (նախորդ տարվա նույն ժամանակահատվածում 61.026.885 ՀՀ դրամ)   վնաս, որից 132.054.143 ՀՀ դրամը  կամ 65%-ը արձանագրվել է պետական շահերի պաշտպանության բաժնի կողմից, մնացած մասը՝ կայազորների զինվորական դատախազությունների:

Հարկ է փաստել նաև, որ հայտնաբերված 203.324.237 ՀՀ դրամից 46.518.570 ՀՀ դրամը հաշվետու ժամանակահատվածում վերականգնվել է։

Խախտումները հայտնաբերվել են հիմնականում տրանսպորտային միջոցների շահագործման,  գնումների գործընթացի կազմակերպման, տրանսպորտային միջոցների և տեխնիկայի շահագործման համար նախատեսված վառելիքի, մատակարարված տարբեր տեսակի ապրանքանյութական միջոցների, հագուստի, սննդամթերքի ստացման, պահպանման և օգտագործման ոլորտներում:

2018թ. 1-ին եռամսյակի ընթացքում պետական շահերի պաշտպանության հարցադրումներով իրականացված հիշյալ ուսումնասիրությունների արդյունքներով նախապատրաստված 25 նյութից 11-ով պաշտոնատար անձանց կողմից դրսևորած պաշտոնեական անփութության, պաշտոնեական կեղծիքների, հափշտակությունների հատկանիշներով հարուցվել են քրեական գործեր։

Հարուցված 11 քրեական գործերից 5-ով՝  պաշտոնեական կեղծիքի, պաշտոնեական դիրքն օգտագործելով յուրացում կամ վատնում կատարելու դիտավորությամբ գույքը ոչնչացնելու համար մեղադրանք է առաջադրվել 10 անձի, որոնցից 3-ը՝ զորամասի հրամանատարի տեղակալ, 3-ը՝ ծառայության պետ, 2-ը՝ պահեստապետ և 2-ը քաղաքացիական անձ։

Միայն հարուցված քրեական գործերով պետությանը պատճառված վնասի չափը կազմել է 134.520.935 ՀՀ դրամ:

Ուսումնասիրությունների արդյունքում արձանագրված և չվերկանգնված վնասների մի մասի վերաբերյալ քննվում են քրեական գործեր, մյուս մասի վերաբերյալ ուսումնասիրությունները շարունակվում են կամ գտնվում է վերականգնման փուլում: Այդ նպատակով կիրառվում են անհրաժեշտ դատախազական ներգործության միջոցներ։

2018թ. 1-ին եռամսյակում պետական շահերի պաշտպանության բաժնի և կայազորների զինվորական դատախազությունների կողմից քաղաքացիական կամ քրեական դատավարության կարգով ներկայացվել է ընդհանուր 8.777.100 ՀՀ դրամ հայցապահանջով 3 հայցադիմում: Դրանցից 2-ով հայցապահանջները բավարարվել են ամբողջությամբ, իսկ 1-ով վնասը բռնագանձելու պահանջի մասին հայցադիմումը դեռևս չի քննվել։ Օրենքով սահմանված կարգով ներկայացվել է միջնորդություն հայցի ապահովման միջոց կիրառելու վերաբերյալ, որը դատարանի կողմից բավարարվել է։ Միջնորդության վերաբերյալ տրված կատարողական թերթը ներկայացվել է կատարման, հարուցվել է կատարողական վարույթ։
