Վերաքննիչ քրեական դատարանն այսօր ամբողջությամբ բավարարել է մեղադրող դատախազի միջնորդությունը և բեկանել Սյունիքի մարզի առաջին ատյանի ընդհանուր իրավասության դատարանի դատավճռով բնակարան ապօրինի մուտք գործելու եղանակով կատարված գողություն կատարելու համար Հասմիկ Սարգսյանին 6 տարի 6 ամիս ժամկետով ազատազրկման դատապարտելու վերաբերյալ դատավճիռը և վերջնական պատիժ է նշանակել ազատազրկում՝ 5 տարի ժամկետով։

Գլխավոր դատախազության հանրային կապերի բաժնից NEWS.am-ին հայտնեցին, որ վերջինս հնարավորություն է ստեղծում, հղիության հանգամանքը հաշվի առնելով, ՀՀ քրեական օրենսգրքի 78-րդ հոդվածի կիրառմամբ հետաձգել պատժի կրումը, իսկ հետագայում, դատապարտյալի հակաիրավական նոր գործողություններից զերծ մնալու դեպքում, քննարկելի դարձնել  ընդհանրապես պատժի կրումից նրա ազատվելու հարցը:

Հիշեցնենք, որ դեռևս 2017 սեպտեմբերի 29-ի դատավճռով Սյունիքի մարզի ընդհանուր իրավասության առաջին ատյանի դատարանը Հ. Սարգսյանին  մեղավոր էր ճանաչել ՀՀ քրեական օրենսգրքի 177-րդ հոդվածի 3-րդ մասի 1.1 կետով (բնակարան ապօրինի մուտք գործելու եղանակով կատարված գողություն) նախատեսված հանցագործության կատարման համար և դատապարտել ազատազրկման 6 տարի 6 ամիս ժամկետով՝ հաշվի առնելով այնպիսի ծանրացնող հանգամանք, ինչպիսին է առանձնապես վտանգավոր ռեցիդիվի առկայությունը՝ նախկինում ամբաստանյալը երկու անգամ կրկին դատապարտվել էր նույնաբույթ ծանր հանցագործությունների համար։ Ընդ որում վերջին երկու հանցանքները կատարել էր փորձաշրջանի ընթացքում, ինչը ՀՀ քրեական օրենսգրքի 70-րդ հոդվածի 7-րդ մասի համաձայն՝ պատիժը պայմանականորեն չկիրառելը վերացնելու և ռեալ ազատազրկման ձևով պատիժ նշանակելու անվերապահ հիմք է, ինչն էլ հիմք էր ընդունվել դատարանի կողմից։

Նշված դատավճռի դեմ վերաքննիչ բողոք է բերել ամբաստանյալ Հասմիկ Սարգսյանը՝ խնդրելով իր նկատմամբ նշանակված 6 տարի 6 ամիս ժամկետով ազատազրկումը կրկին պայմանականորեն չկիրառել։ Վերջինս Վերաքննիչ դատարան է ներկայացրել անձը բնութագրող մի շարք փաստաթղթեր՝ այդ թվում և ներկայումս հղի լինելու վերաբերյալ բժշկական տեղեկանք, ինչպես նաև ընտանեկան ու սոցիալական վիճակի վերաբերյալ տեղեկանքներ՝ մասնավորապես այն, որ խնամքին են գտնվում անչափահաս երեխաները։

Նկատի ունենալով արդեն իսկ վերը հիշատակված օրենսդրական արգելքը, այսինքն փորձաշրջանի ընթացքում հանցանք կատարած անձի նկատմամբ կրկին պատիժը պայմանականորեն չկիրառելու անթույլատրելիությունը, այնուամենայնիվ, ելնելով մարդասիրության սկզբունքից՝ մեղադրող դատախազը թվարկված բացառիկ հանգամանքների ուժով միջնորդել է Վերաքննիչ դատարանին կիրառել  ՀՀ քրեական օրենսգրքի 64-րդ հոդվածը՝ օրենքով նախատեսված պատժից մեղմ պատիժ նշանակելը, այսինքն 6 տարի 6 ամիս ժամկետով ազատազրկումը կրճատել և վերջնական պատիժ նշանակել 5 տարի ժամկետով ազատազրկումը, ինչն արդեն հետագայում՝ դատավճիռն օրինական ուժի մեջ մտնելու դեպքում, Հ.Սարգսյանին հնարավորություն կտա ՀՀ քրեական օրենսգրքի մեկ այլ հոդվածի՝ 78-րդ հոդվածի կիրառմամբ պատժի կրումը հետաձգել՝ հղիության հանգամանքը հաշվի առնելով։

ՀՀ վերաքննիչ քրեական դատարանն ամբողջությամբ բավարարել է դատախազի միջնորդությունը, բեկանել առաջին ատյանի դատարանի դատավճիռը և Հասմիկ Սարգսյանի նկատմամբ վերջնական պատիժ է նշանակել ազատազրկում՝ 5 տարի ժամկետով։

Միևնույն ժամանակ հարկ է նշել, որ ՀՀ քրեական օրենսգրքի 78-րդ հոդվածը սահմանում է նաև, որ եթե պատժի կրման հետաձգված ժամկետում դատապարտյալը պատշաճ վարքագիծ է դրսևորում, այսինքն խուսափում է հակաիրավական արարքներից, ապա վերջինս  դատարանի որոշմամբ հետագայում կարող է ընդհանրապես ազատվել պատժի կրումից, որպիսի հավանական հնարավորությունը, փաստորեն, տրվել է Հասմիկ Սարգսյանին։
