Այսօր առավոտյան 12-30 ից մինչև երեկոյան 17-30-ը դատարանում քննվում էր Գագիկ Ծառուկյանի օգնական Էդուարդ Բաբայանի գործը։

Նշենք, որ գործի առթիվ առկա սակավաթիվ փաստարկներն ու դրանց քննությունը չէին կարող բավարար լինել այդքան երկար տևողության դատական լսումների համար։ Իսկ առկա բալոր փաստարկները խոսում էին միայն Բաբայանի անմեղության մասին, քանի որ դրանցում հստակ ներկայացված է ամեն բան և հերքում են միջադեպի եղելությունը՝ առավել ևս ֆիզիկական ուժի կիրառումն ու խմբակային ծեծի մասին չհիմնավարված վարկածները։

Ոստի՝ դատարանում առավոտից ծածմմվող այս փաստարկները միայն Բաբայանի օգտին էին և լիարժեք հիմք էին հանդիսանում, որպեսզի նրա ձերբակալության առնչությամբ ներկայացրած բողոքը բավարարվի և նա ազատ արձակվի։ Սակայն նիստի՝ ոչ հիմնավոր և արհեստական երկարաձգումը թույլ էր տալիս ենթադրելու, որ դատարանը ինչ-որ բանի է սպասում։ Իսկ մենք սովոր ենք տեսնել, որ դատարանը հիմնականում վերևից հրայհանգների է սպասում։

Այս տարօրինակ ու անկարկի երկար նիստի մասին նույն կարծիքը հայտնեցին նաև պատգամավորները և նիստի վեցժամյա ձգվածությունը առաջին հերթին կապեցին այս հանգամանքի հետ։ Եվ նիստի ավատը հենց այդ էլ վկայեց, որ առկա է ոչ համաչափ ազդեցություն, ինչը հինք է տալիս ենթադրելու, որ գործ ունենք արդարադատությունւց դուրս այլ շարժառիթների հետ։ Դատարանը սպասում էր ցուցումների և այս ցուցումներին ենթարկվելով էլ՝ ի վերջո որոշեց մերժել ազատ արձակման մասին բողոքը։

Թե որքան ժամանակ կարող է ոչ իրավաչափ կերպով ու ապացույցների բացակայության պարագայում դատարանը Էդուարդ Բաբայանին պահել անազատության մեջ, ցույց կտա ժամանակը, բայց եթե մեր նոր Հայաստանում ևս դատարանը շարունակելու է գործել վերևից հրահանգավորման մեխանիզմով, ուրեմն արդար դատական համակարգի ու իրական արդարադատության մասին բոլոր խոսակցություններն ու ձգտումները շարունակելու են մնալ պատրանք։
