Դժվար է հավատալ, որ դատաբժշկական քեղծ փորձաքննությունը կարող է դառնալ անմեղ մարդու կալանավորման հիմքը, բայց արի ու տես, որ սա հայաստանյան իրականություն է և ցավոք հիմա էլ դատաիրավական համակարգում «գործ դզելու» ստոր գործելաոճը կա ։

Էդուարդ Բաբայանի կալանավորումը վերջին շրջանում բավականին լայն քննարկման արժանացավ, եղան տարբեր կարծիքներ դեպքի վերաբերյալ, բայց ցանկացած գիտակից մարդ կհասկանա, որ կեղծ դատաբժշկական փորձաքննության վրա հիմնված քրեական գործը ինքնին շինծու գործ է, իսկ դրա շրջանակներում մարդուն կալանավորելը՝ ապօրինի:

Դատաբժշկական փորձաքննության արդյունքների համաձայն՝ ենթադրյալ տուժող Վյաչեսլավ Հարությունովը բազմակի հարվածների արդյունքում ստացել է ուղեղի ցնցում, բազմաթիվ սալջարդեր, կողոսկրի կոտրվածք, ծակվել է նրա թոքը, բայց արի ու տես, որ «շատ ծանր վիճակում գտնվելով» Հարությունովը դեպքի երկրորդ օրն իր իսկ դիմումով դուրս է գրվել հիվանդանոցից։

Աշխարհում չի գտնվի մի բժիշկ, ով հավատա, որ նման բան հնարավոր է, բայց արի ու տես, որ Հայաստանում դա հնարավոր է, ավելին՝ այս հանգամանքի վրա իրավապահ համակարգում աշխատող անձիք աչք են փակում։

Հարությունովի՝ դեպքի երկորրդ օրը լրագրողներին տված հարցազրույցներում ակնհայտ երևում է Հարությունովի ֆիզիկական ակտիվությունը, նա ազատ շարժում է ձեռքերը, բարձր ձայնով խոսում, իսկ դեմքի վրա չկա որևէ հետք կամ քերծվածք։ Համացանցում տարածված տեսանյութերը, որտեղ երևում է Հարությունովի բացարձակ առողջ լինելու հանգամանքը, ևս մեկ անգամ ապացուցում են, որ դատաբժշկական փորձաքննությունը ֆանտաստիկայի ժանրից է։

Լրագրողներին տված վերջին հարցազրույցում Հարությունովը ներկայացրեց մի ուշագրավ հանգամանք ևս. պարզվում է, քննչական մարմնում Հարությունովի վրա իրականացվել է հոգեբանական ճնշում և սպառնալքիներ՝ ցանկալի ցուցմունք կորզելու նպատակով։ Մասնավորապես նրան ցույց են տվել ինչ-որ տեսանյութեր և ասել, որ պետք եղած ցուցմունքը չտալու դեպքում այդ տեսանյութերը կհայտնվեն համացանցում և նրա հետ հաշվերհարդար կտեսնեն, ինչը բացահայտ սպառնալիք է և շանտաժ:

Ստացվում է, որ որոշ օղակներ պատվիրատուի դերում հանդես գալով՝ ջանասիրաբար փորձում են քողարկել ակնհայտ փաստերը, փոխարենը առաջ քաշելով իրականում գոյություն չունեցող վարկածներ ու «փաստեր»։

Նոր իրողության պայմաններում աններելի եմ համարում նման քննության անցկացումը և ավելի աններելի կլինի, եթե չպատժվեն նրանք, ովքեր կատարում են այս ամենը: Դատաիրավական համակարգում չպետք է լինեն կեղծ եզրակացություն տվող դատաբժիշկներ, սպառնացող քննիչներ, և նրանց պատվիրատու հովանավորները, և ոչ միայն չպետք է լինեն, այլև պետք է ենթարկվեն օրենքով սհմանված խիստ պատժի:
