Վերջին շրջանում արդարադատության նախարար Արտակ Զեյնալյանին և ՀՀ արդարադատության նախարարություն են ներկայացվում բազմաթիվ դիմում-խնդրանքներ՝ նախկինում որոշակի ժամկետով, ինչպես նաև ցմահ ազատազրկման դատապարտված անձանց գործերի վերանայման վերաբերյալ: Ինչպես տեղեկացնում է «Արմենպրես»-ը, Արտակ Զեյնալյանը «Ֆեյսբուք» սոցիալական ցանցի իր էջում գրել է, որ քրեական գործերի վերանայումն իրենից ներկայացնում է օրենքով սահմանված որոշակի հստակ ընթացակարգ, որն ամրագրված է ՀՀ քրեական դատավարության օրենսգրքով: 

«Ուշադրության է արժանի այն հանգամանքը, որ գործերի վերանայման միակ ընթացակարգը՝ Օրենսգրքով նախատեսվածն է, որտեղ նաև բացակայում է որոշակի ժամկետով կամ ցմահ ազատազրկման դատապարտելու վերաբերյալ դատական ակտերի վերանայման ընթացակարգի որևէ տարանջատում:

Օրենսգրքով, որպես օրինական ուժի մեջ մտած դատական ակտերի վերանայման հիմք սահմանված են  նոր երևան եկած (նոր փաստ) կամ նոր հանգամանքների (ՄԻԵԴ կամ ՍԴ դատական ակտ) ի հայտ գալը, ինչպես նաև այն բացառիկ դեպքը, երբ գործի նախորդ դատական քննության ընթացքում թույլ են տրվել նյութական կամ դատավարական իրավունքի այնպիսի հիմնարար խախտումներ, որոնց արդյունքում ընդունված դատական ակտը խաթարում է արդարադատության բուն էությունը»,- գրել է Զեյնալյանը:

Ըստ արդարադատության նախարարի` օրենսգրքով հստակ նախատեսված է, որ վերանայման իրավասությամբ օժտված են միայն վերաքննիչ կամ վճռաբեկ դատարանները, ինչպես նաև սպառիչ սահմանված է վերանայման բողոք ներկայացնելու իրավունք ունեցող անձանց շրջանակը, որտեղ, իրավացիորեն, ներառված չեն գործադիր իշխանության մարմինները, ներառյալ՝ ՀՀ արդարադատության նախարարությունը և նախարարը: 
«Իսկ ես իրավասու եմ կատարելու միայն այնպիսի գործողություններ, որոնց համար լիազորված եմ Սահմանադրությամբ կամ օրենքներով: 

Ամփոփելով՝ գտնում ենք, որ վերոգրյալ երեք հիմքերով դատական ակտը վերանայելու բողոք ներկայացնելու իրավունք ունեցող անձանց շրջանակում գործադիր իշխանության մարմնի ներկայացուցիչներին (այդ թվում` ՀՀ արդարադատության նախարարին) չներառելը բխում է կողմերի հավասարության, մրցակցության, դատական մարմինների անկախության սահմանադրական սկզբունքներից, որն իր հերթին հանդիսանում է իրավունքի գերակայության ապահովման անհրաժեշտ նախապայման և արդար դատաքննության իրավունքի հիմնական երաշխիքը»,- գրել է նախարարը:
