Աշխատանքի և սոցիալական հարցերի նախարարությունը նախատեսում է ուժեղացնել աշխատանքի տեսչական ինստիտուտը

ՀՀ աշխատանքի և սոցիալական հարցերի նախարարությունը քննարկումներ է անցկացնում Աշխատանքի տեսչության վերաբացման կամ գործող Առողջապահության և աշխատանքի տեսչությանը նոր գործառույթներ ավելացնելու ուղղությամբ:

«Արմենպրես»-ի հետ զրույցում նախարարի տեղակալ Արման Ուդումյանը նշեց, որ աշխատանքային օրենսդրության պահանջների ամբողջական կատարման համար բացակայում է պետական վերահսկողական մարմինը:

«Մենք այսօր ունենք Առողջապահական և աշխատանքի տեսչական մարմին, որը զբաղվում է աշխատանքի վայրում աշխատողների առողջության և անվտանգության խնդիրներով, դրանց վերահսկողական գործառույթով: Այնինչ, որոշ խնդիրներ ու գործառույթներ կան, որոնք դուրս են մնացել այդ մարմնի վերահսկողությունից: Այլ պետական մարմին, որը կծածկի այդ հատվածը, այս պահին փաստացի չունենք»,-ասաց նախարարի տեղակալը: 

Նրա խոսքով՝ Առողջապահական և աշխատանքի տեսչական մարմինը բաց է  թողնում որոշ գործառույթներ, ինչպիսին են, օրինակ, հանգստի ռեժիմի պահպանումը, արտաժամյա աշխատանքի դիմաց վճարումները, ամենամյա արձակուրդի նկատմամբ վերահսկողությունը, աշխատավարձի վերջնահաշվարկի վճարումը և այլն: 

«Դրա հետ կապված՝ կարևորում ենք ունենալ կամ առանձին տեսչական մարմին, կամ Առողջապահական և աշխատանքի տեսչական մարմնի ներսում ավելացնել նաև այս բլոկը: Ասեմ, որ նախկինից քաղած դասերից հանգում ենք հետևյալին. մենք փորձելու ենք նոր կառույցով կամ առկա կառույցի գործառույթների ավելացմամբ  բացառել միայն պատժող և տուգանող բնույթը: Այսինքն՝ նախատեսում ենք ավելի մեծ շեշտադրում կատարել խորհրդատվական գործառույթին: Այն կլինի գործատուի հետ աշխատող կառույց, որ չգնանք տուգանքի ճանապարհով, այլ խորհրդատվություն տանք  գործատուին, ներկայացնենք հնարավոր ռիսկերը: Տուգանքը և տույժը մնան վերջին քայլ»,-ասաց Արման Ուդումյանը:

Նախարարի տեղակալն ընդգծեց, որ այն կարևոր օղակ է աշխատողի համար: Խնդիր առաջանալիս կդիմեն կոնկրետ մարմնին՝ որոշ դեպքերում զերծ մնալով դատական գործընթացներից:

«Այս պահին գործող օրենսդրությամբ վարձու աշխատողը խնդրի դեպքում դիմում է դատարան, որտեղ էլ գործը պետք է քննվի երեք ամսում: Հաշվի առնելով մեր իրականությունը, կարծում եմ, որ իրատեսական չէ, երբ նման դեպքում աշխատողը կդիմանա ու կաշխատի: Աշխատանքի տեսչական մարմնի առկայությունը նույնիսկ զսպող դեր կարող է ունենալ գործատուի համար: Արդեն կլինի հասցեական մարմին, որն արագ կարող է արձագանքել»,-հավելեց Արման Ուդումյանը:

Այս համատեքստում նախարարի տեղակալը կարևորեց նաև արհմիությունների ինստիտուտի զարգացումը: Նա նշեց, որ այս կառույցները պետք է լինեն անկախ, իրենք իրենց ներսում փորձեն զարգանալ: Այստեղ պետության անելիքը պետք է լինի համապատասխան օրենսդրական դաշտ ապահովելը:
