Սարի թաղի դեպքերի վերաբերյալ քրեական գործով վարույթը ոչ թե կարճվել, այլ կասեցվել է. ՀՔԾ-ն պարզաբանում է ներկայացրել

 Հաշվի առնելով Սարի թաղում 2016 թվականին տեղի ունեցած դեպքերի առթիվ քննվող քրեական գործով վարույթը կասեցնելու վերաբերյալ զանգվածային լրատվամիջոցների և հանրության շրջանում տարածված հակասական մեկնաբանությունները` ՀՀ հատուկ քննչական ծառայությունն անհրաժեշտ է համարում հայտնել, որ տվյալ քրեական գործով վարույթը չի կարճվել, այլ կասեցվել է, ինչն ամենևին չի ենթադրում, որ քրեական գործով կատարվող քննչական գործողությունները և օպերատիվ-հետախուզական միջոցառումները դադարեցվել են:

Ինչպես «Արմենպրես»-ին տեղեկացրին ՀՀ հատուկ քննչական ծառայությունից, մասնավորապես, ՀՀ քրեական դատավարության օրենսգրքի 258-րդ հոդվածի 2-րդ մասը սահմանում է, որ քննիչը քրեական գործով վարույթը կասեցնելուց հետո ինչպես անձամբ, այնպես էլ հետաքննության մարմնի միջոցով ձեռնարկում է միջոցներ որպես մեղադրյալ ներգրավման ենթակա անձին հայտնաբերելու կամ մեղադրյալի գտնվելու տեղը պարզելու, քննությունից խուսափող մեղադրյալին հետախուզելու ուղղությամբ:

Նույն հոդվածի 3-րդ մասի համաձայն` անհրաժեշտության դեպքում քննիչը կարող է կատարել քննչական համապատասխան գործողություններ:

Քրեական գործը կասեցնելու մասին տուժողներին և նրանց ներկայացուցիչներին ծանուցելիս ՀՀ հատուկ քննչական ծառայության քննիչի կողմից նույնպես պարզաբանվել է, որ հանցանք կատարած անձանց հայտնաբերելու ուղղությամբ ձեռնարկվող օպերատիվ-հետախուզական միջոցառումները և քննչական գործողությունները շարունակվում են: Անհրաժեշտության դեպքում ՀՀ քրեական դատավարության օրենսգրքի 260-րդ հոդվածի համաձայն` քրեական գործով կասեցված վարույթը կարող է վերսկսվել և կատարվեն դատավարական գործողություններ, այդ թվում` առանց մեղադրյալների մասնակցության:

ՀՔԾ-ն հարկ է համարում ևս մեկ անգամ տեղեկացնել, որ հիշյալ քրեական գործով  9 անձի, այդ թվում` ոստիկանության ծառայողի, մեղադրանքներ են առաջադրվել տարբեր հանցավոր արարքների կատարման համար: Նրանցից 8-ի վերաբերյալ մեղադրական դատավճիռները մտել են օրինական ուժի մեջ, իսկ 1-ի վերաբերյալ դատաքննությունը շարունակվում է:

Նշված քրեական գործով շարունակվելու են հանցանք գործած մյուս անձանց հայտնաբերմանն ուղղված քննչական գործողություններն ու օպերատիվ-հետախուզական միջոցառումները:
