ՊԱՇՏՈՆԱԿԱՆ ՀԱՅՏԱՐԱՐՈՒԹՅՈՒՆ

Հարգելի՛ ուսանողներ,

Ինչպես գիտեք, ԵՊՀ Ուսանողական խորհուրդը 2018թ. նոյեմբերի 19-ին ՀՀ կրթության և գիտության նախարարության հաստատմանն է ներկայացրել արտահերթ համագումարում հաստատված ՈՒԽ նոր խմբագրությամբ կանոնադրությունը, մինչդեռ՝ նախարարության կողմից վերոնշյալ կանոնադրությունը հաստատելու կամ կանոնադրության հաստատումը մերժելու մասին որևէ գործողություն մինչ օրս չի իրականացվել:

«Վարչարարության հիմունքների և վարչական վարույթի մասին» ՀՀ օրենքի (այսուհետ՝ Օրենք) 46-րդ հոդվածի 1-ին մասի համաձայն՝ վարչական վարույթի առավելագույն ժամկետը 30 օր է: Նույն հոդվածի 2-րդ մասի համաձայն՝ վարչական վարույթի ժամկետն սկսվում է դիմումը տվյալ վարչական մարմնում մուտքագրելու օրվանից: Այսինքն, նախարարության կողմից ԵՊՀ ՈՒԽ կանոնադրության հաստատման վերաբերյալ վարչական ակտ կայացնելու համար ժամկետը սկսել է 2018 թվականի նոյեմբերի 19-ից և ավարտվել 2018թ. դեկտեմբերի 20-ին:

Օրենքի 48-րդ հոդվածի 1-ին մասի համաձայն՝ եթե վարչական ակտ ընդունելու իրավասություն ունեցող վարչական մարմինը ներկայացված դիմումի հիման վրա հարուցված վարույթի արդյունքում օրենքով սահմանված ժամկետում որևէ որոշում չի կայացնում, ապա վարչական ակտը համարվում է ընդունված, և դիմողը կարող է ձեռնամուխ լինել համապատասխան իրավունքի իրականացմանը:

Ելնելով վերոգրյալից և հաշվի առնելով այն հանգամանքը, որ նախարարությանը հասցեագրված դիմումը ներկայացվել է Օրենքի 31-րդ հոդվածի 1-ին մասի ա, դ, ե, կետերի պահանջների պահպանմամբ, ինչպես նաև այն հանգամանքը, որ վարչական ակտ ընդունելու իրավասություն ունեցող մարմինը՝ ՀՀ կրթության և գիտության նախարարությունը, Օրենքի 46-րդ հոդվածով սահմանված 30 օրյա ժամկետում չի կայացրել համապատասխան վարչական ակտ՝ ԵՊՀ ՈՒԽ կանոնադրությունը Օրենքի 48-րդ հոդվածի ուժով համարվում է հաստատված:

Որպես հավելում փաստենք նաև այն, որ ՀՀ վարչապետի պաշտոնակատարը 2018թ. դեկտեմբերի 28-ի թիվ 1690-Ա որոշմամբ հաստատել է ԵՊՀ հոգաբարձուների խորհրդի կազմը՝ ներառյալ Ուսանողական խորհրդի կողմից ներկայացված ուսանող-անդամներին: Այսինքն, ՀՀ վարչապետը իր կոնկլյուդենտ գործողությամբ ևս մեկ անգամ ճանաչել է ԵՊՀ ուսանողական խորհրդի օրինական կարգավիճակը` որպես ԵՊՀ ուսանողության ներկայացուցչական մարմին:
