42-ամյա Ռազմիկ Հ.-ին մեղադրանք էր առաջադրված սպանության փորձի ու խուլիգանության համար՝ ՀՀ քրեական օրենսգրքի 34-104 հոդվածի 2-րդ մասի 10-րդ կետով և 258 հոդվածի 1-ին մասով:

Ըստ մեղադրանքի՝ 2016 թվականի նոյեմբերի 11-ի երեկոյան Ռազմիկը գնացել է Դիլիջանի «Միմինո» սրճարան ու բարձրաձայն հարցրել է. «Ստեղ տղա կա՞»: Ապա, ըստ մեղադրանքի, նա «անհիմն վիճաբանել է այդ հարցին արձագանքած մարդկանց հետ, առանց հրավերի նստել է սեղաններից մեկի մոտ՝ «սեղանակցել է… իր սանձարձակ վարքագծով խաթարել է սրճարանի բնականոն աշխատանքը՝ շուրջ 15 րոպե կոպիտ կերպով խախտել է հասարակական կարգը…»:

Սրճարանի սեփականատեր Արմեն Մ.-ն Ռազմիկին դուրս է բերել սրճարանից: Ժամը 18-19-ի սահմաններում առաջացած տարաձայնությունները հարթելու նպատակով Ռազմիկն ու Արմեն Մ.-ն, ըստ մեղադրանքի, մեկնել են Տավուշի մարզի Թեղուտ գյուղի 1-ին փողոցի սկզբնամաս, որտեղ Ռազմիկը, ըստ մեղադրանքի, բարձրաձայն հայհոյանքներ տալով՝ խուլիգանական դրդումներով Արմեն Մ.-ին կյանքից զրկելու դիտավորությամբ իր մոտ եղած դանակով մի քանի անգամ հարվածել է վերջինիս մարմնի տարբեր մասերին, այդ թվում՝ կրծքավանդակին՝ նրա առողջությանը պատճառելով ծանր վնաս և, հանցագործությունն ավարտին չհասցնելով, դիմել է փախուստի:

 

Ռազմիկ Հ.-ն իրեն մեղավոր է ճանաչել մասնակիորեն: Նա հայտնել է, որ դեպքի օրը՝ 2016 թվականի նոյեմբերի 11-ին, գնացել է Դիլիջանում Արմեն Մ.-ին պատկանող սրճարան: Արմենն իր ընկերն է, ինքը նրա հետ նորմալ հարաբերությունների մեջ է: Իրեն մեղավոր է ճանաչում միայն «Միմինո» սրճարանում խուլիգանություն անելու համար, բայց ինքն Արմենին չի դանակահարել:

Երբ Արմենն իրեն դուրս է բերել սրճարանից, մեքենայով տարել ու իջեցրել է կանգառում՝ Դիլիջանի շրջադարձի մոտ: Ինքը պատահական մեքենայով գնացել է Թեղուտ գյուղ՝ իրենց տուն: Այդ օրը տանից դուրս չի եկել: Առավոտյան լսել է, որ «Միմինո» սրճարանում տեղի ունեցածի պատճառով իրեն են փնտրում: Այդ պատճառով փախուստի է դիմել: Բայց հետագայում լսել է, որ իր «գլխին սարքել են», կամովին ներկայացել է ոստիկանության բաժին:

Չի կարող ասել, թե ինչու է պաշտպանության տակ գտնվող վկան ցուցմունք տվել՝ իբր ինքն է դանակահարել Արմենին: Արմենն իր ընկերն է, իրենց միջև թշնամանք չկա: Այո, ինքը սրճարանում կոպիտ է խոսել: Տուն գնալիս չի մտել խանութ, դանակ չի փնտրել…

Գործով վկաները, ովքեր խուլիգանության պահին եղել էին «Միմինո» սրճարանում, Ռազմիկ Հ.-ի դեմ ցուցմունք չեն տվել:
