Պաշտոնատար անձինք ապօրինաբար թույլատրել են համայնքային եւ բնակիչների բաժնային սեփականության տարածքներում մասնավոր շինարարության կատարումը եւ ապահովել շինության նկատմամբ իրավունքի պետական գրացումը, հարուցվել է քրեական գործ։ Այս մասին NEWS.am-ին հայտնում են ՀՀ դատախազությունից։

ՀՀ գլխավոր դատախազության պետական շահերի պաշտպանության վարչությունն ուսումնասիրության առարկա է դարձրել քաղաքացիների բողոքի հիման վրա Երեւանի ավագանու նախկին անդամի կողմից ներկայացված՝ Երեւան քաղաքի Աջափնյակ վարչական շրջանում գտնվող բազմաբնակարան շենքի տարածքում շինարարության վերաբերյալ տեղեկատվությունը:

Ուսումնասիրության շրջանակներում Երեւանի քաղաքապետարանից, ՀՀ անշարժ գույքի կադաստրի պետական կոմիտեից եւ ՀՀ քաղաքաշինության, տեխնիկական եւ հրդեհային անվտանգության տեսչությունից պահանջվել եւ ստացվել են համապատասխան փաստաթղթեր: Դրանց ուսումնասիրությամբ պարզվել է, որ Երեւանի քաղաքապետարանի եւ ՀՀ ԿԱ անշարժ գույքի կադաստրի պետական կոմիտեի պաշտոնատար անձինք թույլատրել են Աջափնյակ վարչական շրջանի Հալաբյան փողոցում գտնվող բազմաբնակարան շենքի սեփականատերերի բաժնային, ինչպես նաեւ Երեւան համայնքի սեփականություն հանդիսացող կից հողամասերում շինարարության իրականացումը, ապա կառուցված շինության նկատմամբ կատարել են իրավունքների պետական գրանցում՝ անտեսելով այն հանգամանքը, որ բացակայել են անշարժ գույքի մասն առանձնացնելու վերաբերյալ բազմաբնակարան շենքի սեփականատերերի ժողովի որոշումը, ինչպես նաեւ քաղաքացուն կառուցապատման իրավունքով հողամաս տրամադրելու իրավական հիմքերը: Դրա հետեւանքով Երեւան համայնքը եւ շենքի սեփականատերերը զրկվել են շուրջ 122քմ. մակերեսով սեփական  գույքը իրենց հայեցողությամբ տնօրինելու, տիրապետելու եւ օգտագործելու հնարավորությունից:

Հաշվի առնելով, որ ուսումնասիրության արդյունքում ձեռք են բերվել Երեւանի քաղաքապետարանի եւ ՀՀ ԿԱ անշարժ գույքի կադաստրի պետական կոմիտեի պաշտոնատար անձանց կողմից առերեւույթ պաշտոնեական լիազորությունների չարաշահման հանցագործության հատկանիշներ պարունակող տվյալներ՝ նշված դեպքի առթիվ ՀՀ գլխավոր դատախազության պետական շահերի պաշտպանության վարչության ավագ դատախազի կողմից հարուցվել է քրեական գործ՝ ՀՀ քրեական օրենսգրքի 308-րդ հոդվածի 1-ին մասով:
