Վերաքննիչ քրեական դատարանում, դատավոր Արմեն Դանիելյանի նախագահությամբ շարունակվում է ՀՀ երկրորդ նախագահ Ռոբերտ Քոչարյանի եւ մյուսների գործով բողոքների քննությանը։ Ինչպես նախորդ, այնպես էլ այս դատական նիստին ներկա չէ Ռոբերտ Քոչարյանը։ Նրա պաշտպան Հովհաննես Խուդոյանը տեղեկացրեց, որ Քոչարյանը նպատակահարմար չի գտնում մասնակցելու դատավարությանը։

Գլխավոր դատախազությունը եւ տուժող Արթուր Ավագյանը բողոքարկել են մայիսի 18-ի՝ Երեւան քաղաքի ընդհանուր իրավասության դատարանի՝ ՀՀ երկրորդ նախագահ Ռոբերտ Քոչարյանի նկատմամբ ընտրված խափանման միջոց կալանավորման որոշումը փոփոխելու եւ նույն դատարանի մայիսի 20֊ի՝ քրեական գործի վարույթը կասեցնելու եւ Սահմանադրական դատարան դիմելու որոշումը:

Նրանք պահանջում են՝ վերացնել Ռոբերտ Քոչարյանի նկատմամբ ընտրված անձնական երաշխավորություն ընտրելու վերաբերյալ որոշումը եւ նրա նկատմամբ, որպես խափանման միջոց կիրառել կալանավորումը։

Նշենք, որ ներկայացված բողոքների վերաբերյալ 4 առարկություն է ներկայացրել Ռոբերտ Քոչարյանի պաշտպան Հայկ Ալումյանը։

 Մասնավորապես Ալումյանն առարկել է ՍԴ դիմելու եւ գործի վարույթը կասեցնելու մասին դատարանի մայիսի 20–ի որոշման դեմ տուժողների իրավահաջորդի ներկայացուցչի վերաքննիչ բողոքը վարույթ ընդունելու դեմ։

Փաստաբանը խնդրել է առաջին ատյանի դատարանի մայիսի 20–ի որոշման դեմ դատախազության, ինչպես նաեւ տուժողների իրավահաջորդների ներկայացուցիչներ Վահե Գրիգորյանի եւ Սեդա Սաֆարյանի ներկայացրած վերաքննիչ բողոքները թողնել առանց քննության։

Հիշեցնենք, որ Երեւանի ընդհանուր իրավասության դատարանի դատավոր Դավիթ Գրիգորյանը մայիսի 18-ին, քննելով Քոչարյանի խափանման միջոցի հարցը, որոշել էր նրան ազատել կալանքից Արցախի Հանրապետության նախկին եւ ներկա նախագահներ Արկադի Ղուկասյանի եւ Բակո Սահակյանի անձնական երաշխավորությամբ:

Երկու օր անց՝ մայիսի 20-ին, դատարանը որոշել էր կասեցնել Ռոբերտ Քոչարյանի, Յուրի Խաչատուրովի, Սեյրան Օհանյանի եւ Արմեն Գեւորգյանի գործի վարույթն ու այն ուղարկել Սահմանադրական դատարան` պարզելու համար այս գործով կիրառման ենթակա ՀՀ քրեական օրենսգրքի 300.1-րդ հոդվածի 1-ին մասի եւ դրա հետ փոխկապակցված ՀՀ քրեական օրենսգրքի 300-րդ հոդվածի 1-ին մասի (մինչեւ 2009 թվականի մարտի 20-ին ընդունված ՀՕ-53-Ն օրենքի ուժի մեջ գտնվելը գործող խմբագրությամբ) համապատասխանությունը ՀՀ Սահմանադրության պահանջներին: ՍԴ–ն էլ օրերս որոշում է կայացրել մեկ ամսով երկարաձգել է Քոչարյանի եւ մյուսների գործով դատավորի դիմումն ուսումնասիրելու ժամկետը։
